  • [01] L'interdiction de la publicité pour le tabac prend effet le 31 juillet

    Markos Kyprianou, commissaire européen chargé de la santé et de la protection des consommateurs, s'est félicité de l'entrée en vigueur de la directive de l'UE sur la publicité pour le tabac au 31 juillet. Adoptée par le Parlement européen et le Conseil en 2003 (voir IP/02/1788), cette directive interdit la publicité pour le tabac dans la presse écrite, à la radio et sur internet. Elle interdit aussi le parrainage de manifestations culturelles et sportives transfrontières au profit du tabac. Bien que la plupart des pays de l'UE aient déjà adopté les dispositions législatives nécessaires ou soient en passe de le faire, il n'est pas sûr que tous l'auront fait au 31 juillet. Indépendamment de cela, la Commission a adopté un rapport sur la mise en oeuvre de la directive relative aux produits du tabac.

    [02] Posting of workers from the new Member States : Commission asks the Netherlands to put an end to unjustified restrictions

    The European Commission has decided to formally request the Netherlands to review its rules whereby Community businesses must obtain work permits for staff from certain new Member States before they can be temporarily posted to the Netherlands to perform services. The Commission considers that this requirement constitutes a violation of the rules of the Treaty regarding the freedom to provide services (Article 49 of the EC Treaty). The Commission's request takes the form of a reasoned opinion, the second stage in the infringement procedure under Article 226 of the EC Treaty. If the Dutch authorities fail to give a satisfactory reply within two months of receiving the reasoned opinion, the Commission may decide to bring the Netherlands before the Court of Justice.

    [03] La Commission autorise pour une année la régulation de l'accès au "haut débit" en France comme tremplin vers plus de concurrence

    France Télécom sera contraint d'offrir, à titre transitoire, l'accès en gros à son réseau national à large bande aux autres acteurs du marché. Cette mesure de régulation, proposée par l'autorité réglementaire française, l'ARCEP, a été autorisée aujourd'hui par la Commission européenne. La mesure s'appliquera jusqu'à ce que les opérateurs de réseaux concurrents aient développé un réseau de collecte et une base de clients suffisamment larges pour leur permettre de continuer à investir dans les services haut débit ("large bande") régionaux, tels que l'accès au web et les services connectant les locaux des utilisateurs au réseau ("boucle locale"). La Commission a demandé à l'ARCEP de réexaminer ce marché dans un an, afin de prendre complètement en compte les nouveaux développements du marché qui peuvent améliorer la concurrence sur le marché de gros du "large bande national" en France.

    [04] First quarter of 2005 : EU25 current account deficit €22.5 billion ; €7.7 billion surplus on trade in services

    According to the latest revisions, the EU25 external current account recorded a deficit of €22.5 billion in the first quarter of 2005, as compared with a deficit of €3.9 billion in the first quarter of 2004 and a deficit of €2.3 billion in the fourth quarter of 2004. In the first quarter of 2005, compared to the first quarter of 2004, a higher deficit was recorded in the goods account (-€22.1 billion compared to -€4.0 billion) while the services account balance remained almost unchanged (+€7.7 billion compared to +€7.6 billion). The surplus in the income account decreased slightly (+€2.5 billion compared to +€3.8 billion) as did the structural deficit in the current transfers account (-€10.6 billion compared to -€11.3 billion). These provisional data, issued by Eurostat, are subject to revision.
