[01] Commission adopts Single Market Action Plan for Amsterdam European
Council
Details of the priority actions required to improve the functioning of the
Single Market by 1 January 1999 have been presented in the Single Market
Action Plan adopted today by the European Commission. Following the
announcement by Commission President Jacques Santer at the December 1996
Dublin European Council, the Action Plan will be presented to the 16-17
June Amsterdam European Council. The Commission will be seeking a renewed
political commitment from Member States to move decisively towards
completion of the Single Market by 1 January 1999 in parallel with the
introduction of the euro. Moreover, an efficient Single Market is a corner
stone of President Santer's Confidence Pact for Employment which aims at
boosting job creation and growth. The Action Plan defines four Strategic
Targets: making the rules more effective, dealing with key market
distortions, removing obstacles to market integration and delivering a
Single Market for the benefit of all citizens. Specific actions will be
implemented under a three phase timetable, with application in the very
short term of urgent actions, rapid adoption of a number of existing
proposals and attaining maximum possible agreement on remaining measures by
1 January 1999.
[02] La Commission déclare que les restrictions aux investissements intra-
communautaires doivent se limiter aux cas prévus par le Traité
La Commission européenne a clarifié, dans une communication qu'elle vient
d'adopter, la portée juridique des dispositions du Traité relatives aux
mouvements de capitaux et au droit d'établissement (art 73b et 52) en ce
qui concerne les investissements intra-communautaires. Les restrictions
qui s'appliquent exclusivement aux investisseurs ressortissants d'autres
Etats membres de l'Union européenne seront jugées incompatibles, à
l'exception des cas prévus par le Traité: ordre public, sécurité, santé et
défense. Les restrictions, même si indistinctement applicables, ne
pourront être admises que pour des raisons impérieuses d'intérêt général
fondées sur des critères objectifs, stables et transparents et si d'autres
mesures moins restrictives permettant de poursuivre les mêmes objectifs
n'existent pas. La Commission, en contact étroit et en constante
coopération avec les autorités nationales, examinera les réglementations en
vigueur et à venir dans les Etats membres, notamment dans le cadre de
programmes de privatisation, en veillant à ce que les libertés
fondamentales puissent pleinement se réaliser.
[03] Commission consults social partners on information and consultation of
employees at national level
The European Commission has decided to consult the social partners at
European Union (EU) level on the issue of information and consultation of
employees at national level. The Commission wishes to examine with the
social partners the need to create a framework to complement national
practices and underpin existing EU legislation, which provides for
information and consultation in specific circumstances (transfer of
undertaking, collective redundancies). This consultation follows a wide
debate which was initiated by the Commission's Communication of 14 November
1995 on Worker Information and Consultation. The social partners have six
weeks to react to this first round of consultation. Following this initial
step, the Commission will, if it considers EU action necessary, issue a
second consultation document on the content of a possible legislative
proposal.
[04] Commission suggests specific measures in view of promoting the
development of voluntary organisations and foundations in Europe
The European Commission adopted a communication on Voluntary Organisations
(Associations) and Foundations. The communication suggests specific
measures, both at national and European level, in favour of the development
of this sector. At Member States level, the measures involve i. a. the re-
examination of the policies and relations of the public authorities with
the sector, the establishment of a clear and helpful legal framework, the
examination of how the financial health of the sector can be secured, and
to ensure better access to European funding programmes. Among the measures
at a European level, the Commission proposes more involvement of voluntary
organisations in European training programmes, better access to European
funding programmes, a European Year of voluntary organisations and European
citizenship, and the development by the sector of a special fund in order
to help the transnational collaboration.
[05] Commission decides to close an investigation on research and
development aid to Olivetti S.p.A.
The European Commission has decided to close an investigation on a proposal
to give research and development aid to Olivetti S.p.A. The Italian
government proposal was to grant aid to the company amounting to some ECU 7,
7 million for the development of portable multimedia personal computers for
a project which began in 1993. An investigation was initiated into the aid
proposal in April 1996 because it did not appear to be in conformity with
European Union state aid rules on research and development. During the
investigation it emerged that the project had been stopped in June 1995,
well before its termination date of January 1998, and prior to the
notification by the Italian authorities to the Commission in December 1995.
The outcome is that the Italian authorities have withdrawn the aid proposal
and undertaken not to grant the aid.
[06] La Commission approuve la création de Fonds de liquidités du Land de
Berlin en faveur des entreprises en difficulté
La Commission européenne a approuvé la création du Fonds de liquidités du
Land de Berlin en faveur des entreprises en difficulté. Ce Fonds de
liquidités du Land de Berlin disposera d'un volume d'intervention de 100
millions de DM (environ 52,5 millions d'Ecus) jusqu'au 31.12.2006. Il a
pour mission d'aider les entreprises de Berlin ayant des difficultés de
trésorerie et qui sont incapables d'assurer leur redressement avec leur
propres ressources ou avec des fonds obtenus auprès de leurs actionnaires
ou par l'emprunt. Le Fonds interviendra à titre subsidiaire dans les cas
où d'autres instruments d'aide ne sont pas disponibles. L'aide est
destinée principalement aux petites et moyennes entreprises. Le Fonds de
liquidités interviendra exclusivement sous forme de prêts à concurrence de
5 millions de DM et sur une durée maximale de 5 ans, avec une franchise de
remboursement à concurrence de 2 ans. Le régime prévoit notamment que
l'entreprise doit soumettre et réaliser un plan de restucturation en vue de
rétablir la viabilité de l'entreprise conformément aux Lignes directices
communautaires pour les aides d'Etat au sauvetage et à la restructuration
des entreprises en difficulté. Les aides en faveur des grandes entreprises
en difficulté doivent être notifiées individuellement.
[07] Commission raises no objection to state aid scheme for Swedish
shipping
The European Commission raised no objection to a state aid scheme for
Swedish shipping to help maintain and enhance employment opportunities and
training places on board Swedish flagged vessels which are operating in
international cargo trades to or from Sweden or in cross trades. The
scheme, an extension of one already in place since 1994, will run until the
end of 2001. The total budget for 1997 is SEK 400 million (ECU 46 million)
and the provision for the following years is similar, but remains subject
to final approval by the budgetary authorities. The Commission found the
scheme compatible with European Union (EU) law and in line with its policy
designed to counter the flagging out trend, to promote employment of EU
seafarers and on-board training.
[08] La Commission conteste le régime de plantations de vignes en France
La Commission européenne a décidé d'entamer une procédure d'infraction à
l'égard de la France parce qu'elle conteste la compatibilité avec la
réglementation communautaire d'une circulaire du Ministère de l'Agriculture
du 16 décembre 1996 ayant pour objet la "mise en place d'un régime de
plantations anticipées de vignes". La Commission estime la circulaire
française contraire aux prescriptions du règlement portant organisation
commune du marché vitivinicole. Le sens de ces dispositions est que
l'intéressé peut procéder à une plantation de vignes uniquement s'il
dispose d'un droit de replantation que lui confère l'arrachage préalable
d'une superficie équivalente plantée en vignes. Au contraire, la
circulaire française autorise l'intéressé à effectuer de nouvelles
plantations "sans utiliser de droit de replantation" et "à différer
l'arrachage d'une surface équivalente jusqu'à l'entrée en production des
jeunes vignes".

[09] La Commission autorise l'acquisition par Mannesmannröhren-Werke de 21%
du capital de Vallourec et l'établissement d'une entreprise commune
réunissant leurs activités de tubes sans soudure
La Commission européenne vient d'approuver une opération par laquelle
Mannesmannröhren-Werke AG, située à Mülheim dans la Ruhr en Allemagne (MRW),
va acquérir 21% des actions de Vallourec SA (Vallourec), située à Boulogne-
Billancourt en France. En outre, MRW et Vallourec vont créer une
entreprise commune réunissant leurs activités de fabrication de tubes sans
soudure. L'opération donnera à MRW le contrôle de facto sur Vallourec.
Dans la mesure où, même sur la base d'une définition étroite du marché de
produits et du marché géographique, l'opération ne créera pas ou ne
renforcera pas de position dominante, la Commission a autorisé l'opération
notifiée au cours de la première phase d'investigation d'une durée d'un
mois.
[10] Droits de l'homme: la Commission approuve le financement d'un vaste
programme de réhabilitation des victimes de la torture
La Commission européenne a approuvé aujourd'hui le financement de 27
projets et programmes dans le domaine de la réhabilitation des victimes de
la torture pour un montant de 3,2 millions d'Ecus. Les projets seront
exécutés par des organisations spécialisées, surtout des Organisations Non
Gouvernementales, dans le monde entier. Ces financements s'inscrivent dans
le prolongement des engagements pris notamment lors du Conseil Européen de
Luxembourg des 28 et 29 juin 1991 et de la communication de la Commission
du 22 novembre 1995 sur "L'Union européenne et les aspects extérieurs de la
politique des droits de l'homme: de Rome à Maastricht et au delà"
esquissant les éléments essentiels d'une stratégie de promotion des droits
de l'homme et de la démocratie.
[11] Padraig Flynn says that the new Treaty must reflect the aspirations of
citizens
(!!! embargo 3.30 pm !!!) Speaking today in the European Parliament in
Brussels, Employment and Social Affairs Commissioner Padraig Flynn said
that the European Union must show its commitment to dealing with the "basic
problems of society, the basic concerns of people. We need to allay fears
about the Union, about the lack of popular perception of a solid social
basis in the process of European integration to date." Mr Flynn called for
progress in Amsterdam in key areas such as fundamental human rights,
equality, the civil and social dialogue and employment. The Commissioner
concluded his remarks with a warning that "Citizens may be willing to
accept that it is crucial to develop the monetary, institutional, and
financial building blocks of the enlargement and modernisation of the
Union. But only if the cement of this whole edifice, the social cohesion
which social policy represents, also receives the attention it deserves.
Because they know that, without it, there is no integration."
