[01] Propriété industrielle : la Commission propose la création d'un
Tribunal du brevet communautaire
La Commission européenne a présenté deux propositions de décisions du
Conseil instituant une juridiction compétente en matière de brevet
communautaire, placée sous l'égide de la Cour européenne de justice,
chargée de régler les litiges concernant le futur système de brevet
communautaire, notamment en matière de contrefaçons et de validité des
brevets communautaires. Selon ces propositions, la compétence de la Cour de
justice serait exercée par un nouveau Tribunal du brevet communautaire. Les
arrêts rendus en matière de droits du brevet communautaire produiraient
ainsi leurs effets dans toute l'UE, ce qui permettrait d'éviter les frais,
inconvénients et confusions qui peuvent apparaître lorsque différentes
juridictions nationales sont appelées à statuer.
[02] La Commission accepte de modifier l'engagement "Rhodia" dans la
décision Hoechst/Rhône-Poulenc
La Commission européenne a accepté une demande d'Aventis visant à vendre sa
participation de 49% dans Wacker Chemie au lieu de sa participation
d'environ 15% dans Rhodia. La Commission, en 1999, a autorisé la
concentration entre Hoechst et Rhône-Poulenc, qui a créé Aventis, sous
condition de ventes de certains actifs pour résoudre les problèmes de
concurrence. La santé financière en déclin de Rhodia a depuis lors rendu la
vente difficile. La vente de Wacker-Chemie permet d'atteindre le même
objectif que celui préalablement poursuivi puisque les problèmes de
concurrence résidaient dans les chevauchements entre les deux entreprises.
[03] Agreement on rural development programmes for Hungary for 2004-2006
In a letter to the Hungarian Agriculture Minister, European Agriculture
Commissioner Franz Fischler confirmed today agreement on the country's
Operational Programme for Agriculture and Rural Development. It will be
formally approved upon accession on 1 May 2004. The programme, covering the
whole territory of Hungary, includes a broad range of ambitious rural
development measures which give a special emphasis to the improvement of
competitiveness, sustainable development, the stabilisation of existing
work places and widening the economic fabric of Hungarian rural areas. The
financial allocation is significant, given that the EU's contribution,
€317.2 million during the period 2004-2006, will be complemented by
national public funding of €105.6 million. This political agreement
concludes the Commission negotiations to launch the Structural Funds
Programming for Hungary for the period 2004-2006.
[04] Pays en développement : l'UE lance un service d'assistance en ligne
pour promouvoir l'accès de ses marchés aux pays en développement
Un nouveau service d'assistance en ligne, introduit par la Commission
européenne (http://export-help.cec.eu.int), fournira aux exportateurs des
pays en développement un outil pour accéder plus facilement au marché
communautaire. Gratuit, ce service d'assistance contient des informations
essentielles sur les droits de douane, la documentation douanière, les
règles d'origine et les statistiques commerciales immédiatement accessibles
en ligne. Une seconde phase, en cours d'élaboration, verra la gamme
d'informations s'étendre aux prescriptions à l'importation par catégorie de
produits, notamment en matière sanitaire et phytosanitaire. Pascal Lamy, le
commissaire européen chargé du Commerce, a déclaré : "En introduisant ce
service d'assistance, notre vœu est d'apporter aux exportateurs des pays en
développement le maximum d'informations et d'aide pour aborder le marché de
l'Union. Nous voulons faire en sorte, notamment, que ces pays tirent le
meilleur parti des préférences commerciales communautaires. Cette démarche
est caractéristique de notre engagement de fournir une assistance technique
aux pays en développement et de transformer en échanges commerciaux un
accès au marché théorique."
[05] Erkki Liikanen calls for more international cooperation to combat
'spam'
European Enterprise and Information Society Commissioner Erkki Liikanen
today called for global cooperation against 'spam' at a two-day OECD
workshop in Brussels. Building on efforts by many countries to combat
'spam', the OECD should rapidly agree a five-point framework to promote
effective legislation against spam, cooperation between enforcement
agencies, self-regulation by industry, technical solutions, and greater
consumer awareness.
[06] €43 million for research projects to boost European agro-food research
While visiting Wageningen University and Research Centre in the Netherlands,
European Research Commissioner Philippe Busquin is attending today an
expert seminar on the trends affecting agriculture and food production.
Agro-food research today has to respond to challenges, such as agriculture
policy reform, enlargement of the European Union, international trade
issues, new technologies and rapidly evolving consumer attitudes. On this
occasion three major new projects are being launched in the agro-food area
that the EU is to support with research funds totalling €43 million through
the Sixth Research Framework Programme (FP6). The projects launched are the
first major FP6 activities which take the "farm-to-fork" approach. SAFE
FOODS is an integrated project on risk analysis in food safety, which aims
to improve consumer protection, NuGO is a network of excellence to
integrate genomics, nutrition and health, and WELFARE QUALITY is an
integrated project on animal welfare and food production (see annex).
