[01] La Commission lance une consultation sur des projets de textes visant
à compléter la réforme des procédures antitrust
En mai 2004, c'est-à-dire dans moins d'un an, un nouveau régime
d'application des règles européennes de concurrence relatives aux accords
restreignant la concurrence et aux abus de position dominante entrera en
vigueur. Ce nouveau régime, approuvé par les gouvernements des Etats
membres l'année dernière, abolit le dispositif de notification centralisée
des accords, en place depuis 1962. La Commission et les autorités
nationales de concurrence fonctionneront désormais comme un réseau au sein
duquel les affaires seront traitées selon le principe de l'autorité la
mieux située. Une telle réforme supprimera toute bureaucratie pour les
entreprises qui, après quarante années d'application des articles 81 et 82
du traité, sont généralement en mesure d'apprécier la légalité de leurs
accords ou de leur comportement. Elle permettra également une mise en œuvre
harmonieuse des règles, dans une Union européenne à vingt-cinq. Pour
compléter le processus de réforme engagé en 1999, la Commission soumet
aujourd'hui à la consultation publique un ensemble de textes
d'accompagnement ("paquet modernisation").
[02] Commission proposes new safe harbour for the licensing of patents and
know how
The European Commission is seeking comments on changes to the competition
rules applicable to the licensing of patents, know how and software
copyright. Technology transfer licensing agreements currently benefit of a
block exemption (= safe harbour) if certain conditions are met. The
Commission proposes a number of changes to the block exemption that will
reduce the regulatory burden for companies, while ensuring an effective
control of agreements between companies holding significant market power.
The new approach must be seen in combination with the modernisation of the
European Union's enforcement rules for antitrust which will come into force
in May 2004.
[03] Commission authorises joint venture between SNPE, SAAB and Patria in
the explosives and propellants sector
The European Commission has approved under the Merger Regulation a proposed
joint venture between the French State-owned SNPE, the Swedish company SAAB
and the Finnish company Patria for the production of explosives and
propellants, used in both civil and military applications. In view of the
limited overlaps and the presence of other large and capable competitors,
the Commission has not identified any serious threats to competition in any
parts of the European Union's territory.
[04] La Commission autorise Philip Morris à acquérir le cigarettier
Papastratos
La Commission européenne a autorisé la filiale néerlandaise de Philip
Morris à acquérir les activités de production et de distribution du
fabricant de cigarettes grec Papastratos. Au terme de son enquête, la
Commission a conclu que l'acquisition ne soulèverait pas de problèmes de
concurrence sur le marché grec des cigarettes.
[05] Les règles en matière de lutte contre la discrimination doivent être
en place avant l'adhésion
Alors qu'approche la deuxième échéance de cette année concernant la
transposition en droit national des règles communautaires de lutte contre
la discrimination, la Commission européenne publie les résultats de
recherches indépendantes consacrées à la législation des pays candidats
relative à la discrimination fondée sur la race ou l'origine ethnique, la
religion ou les convictions, un handicap, l'âge ou l'orientation sexuelle.
L'étude fait état de certains progrès, mais les candidats ont encore du
travail à accomplir pour se mettre en conformité avec les directives d'ici
au 1er mai 2004.
[06] EU-Central America : conclusion of new Political Dialogue and
Cooperation Agreement
On Wednesday 1 October the European Union and Central America successfully
concluded the second and final round of negotiations for a new Political
Dialogue and Cooperation Agreement. The agreed text has been initialled on
2 October in Brussels by Eneko Landaburu, European Commission Director
General for External Relations, and the Ministers of External Relations of
Panama, Harmodio Arias Cerjack, and Nicaragua, Norman Caldera, and the
Viceministers of External Relations of Costa Rica Marco Vinicio Vargas,
Guatemala Alfredo Trinidad, Honduras Anibal E. Quiñónez, and El Salvador
Roberto Interiano.
