  • [01] La Commission décèle des problèmes de concurrence dans un accord de coopération entre Air France et Alitalia

    La Commission européenne a informé Air France et Alitalia qu'elle avait des doutes sérieux quant à la possibilité d'approuver leur accord de coopération sous sa forme actuelle. L'alliance, qui avait été notifiée en vue d'obtenir une autorisation à la fin de l'année dernière, contribue globalement au progrès technique et économique vu les améliorations de connectivité ainsi que les économies et les synergies réalisées par les parties. L'accord va toutefois réduire fortement la concurrence sur les liaisons essentielles entre la France et l'Italie, et notamment entre Paris, d'une part, et Rome et Milan, d'autre part, ce qui serait contraire à l'intérêt des passagers. La Commission invite Alitalia et Air France à réfléchir à ces problèmes afin de trouver une solution qui permette de réaliser l'alliance tout en protégeant les intérêts des consommateurs et en respectant le droit communautaire.

    [02] Un test d'ADN pour lutter contre la fraude liée aux paiements à l'exportation de viande bovine

    La Commission va instaurer de nouveaux tests d'ADN pour la détermination du sexe du bétail afin de lutter contre les demandes frauduleuses de restitution à l'exportation. Le commerce de la viande bovine donne lieu à plusieurs millions d'euros de restitutions à l'exportation octroyées par l'UE, et les sommes allouées pour la viande d'animaux mâles sont nettement plus élevée que celles accordées pour la viande de femelles. Il est donc essentiel de veiller à ce que la déclaration relative au sexe faite au point d'exportation de la viande soit correcte. La nouvelle législation de l'UE, qui entrera en vigueur aujourd'hui, prévoit l'utilisation d'une nouvelle technique mise au point par le Centre commun de recherche (CCR) de la Commission. Le CCR a réalisé une étude de faisabilité sur la base des méthodes analytiques utilisées actuellement. Selon les résultats de cette étude, la technique la plus prometteuse est la réaction en chaîne à la polymérase (RCP) suivie d'une électrophorèse sur gel, qui permet une détermination du sexe rapide et sûre, et s'avère fiable pour une utilisation régulière.

    In April 2002, as compared to April 2001, the volume of retail trade increased by 0.1% in the euro-zone and by 1.4% in the EU15, Eurostat estimates today. Compared to March 2002, sales fell by 0.6% in the euro- zone and by 0.1% in the EU15. In April 2002, as compared to April 2001, retail trade of "food, drinks and tobacco" rose by 0.4% in the euro-zone and by 1.0% in the EU15. The non food sector decreased by 0.5% in the euro- zone but gained 1.6% in the EU15.

    [04] Commission asks ten Member States to implement Directive on the legal protection of designs

    The European Commission has decided to send formal requests to Belgium, Germany, Greece, Spain, Luxembourg, The Netherlands, Austria, Portugal, Finland and Sweden to implement into their national law Directive 98/71/EC on the legal protection of designs. When the Directive was adopted in 1998, Member States themselves agreed to implement it no later than 28 October 2001. The formal requests take the form of 'reasoned opinions', which constitute the second stage of infringement procedures laid down in article 226 of the EC Treaty. Should the Member States concerned fail to give a satisfactory reply within two months, the Commission may refer the matter to the European Court of Justice.

    [05] Reconnaissance des qualifications professionnelles : procédures d'infraction contre l'Autriche, la Belgique, l'Irlande, l'Allemagne et la Grèce

    La Commission européenne a décidé de saisir la Cour de justice à l'encontre de l'Autriche en ce qui concerne sa législation relative aux qualifications professionnelles des dentistes, ainsi qu'à l'encontre de la Belgique et de l'Irlande pour non-transposition de la Directive 2000/5/CE, qui porte notamment sur les professions d'infirmier spécialisé et d'expert en gestion des déchets. D'autre part, la Commission a décidé de demander formellement à l'Allemagne de mettre fin à son refus de reconnaître, selon la directive 93/16/CEE, les titres attestant d'une formation spécifique en médecine générale obtenus dans un autre Etat membre et à la Grèce de modifier sa législation nationale afin d'assurer sa conformité avec la directive 89/48/CEE, relative à la reconnaissance des diplômes d'enseignement supérieur qui sanctionnent des formations professionnelles d'une durée minimale de trois ans. Ces demandes de la Commission prendront la forme d' "avis motivés", deuxième étape de la procédure d'infraction en vertu de l'article 226 du traité CE. Si les autorités allemandes et grecques ne répondent pas de façon satisfaisante dans les deux mois suivant la réception des avis motivés, la Commission peut décider de saisir la Cour de justice.

    [06] Pre-accession farm aid for Poland : go-ahead for €171.6 million Sapard payments

    On 28 June, European Agriculture Commissioner Franz Fischler has signed a decision to confer the management of Sapard aid to the Polish authorities, enabling Poland to commence the implementation of its Sapard programme. Under this scheme, Poland will now be entitled to grant aid of which the EU contribution is €171.6 million annually. Payment of the first advance to the Sapard euro account in the National Fund can now be made (of about €40 million). This first decision on the provisional conferral of management of aid covers three main, and two supporting measures of the Polish Sapard programme : "Improvement in processing and marketing of food and fishery products", "Investments in agriculture holdings", "Development of rural infrastructure", accompanied by "Vocational training" and "Technical assistance". With this decision, all CEEC countries except Hungary and Romania have their Sapard programmes up and running. This decision will be formally adopted in the days to come.

    [07] "Commission has no intention to restrict access of cereals and rice to the EU market", says Franz Fischler

    Responding to allegations that the EU intended to restrict EU imports of cereals and rice made by US Agriculture Secretary Ann Veneman and US Trade Representative Robert Zoellick, European Farm Commissioner Franz Fischler declared the following last Friday : "I am deeply troubled by this misunderstanding". In a news release (No. 0268.02) from 28 June 2002, Secretary Veneman and Ambassador Zoellick claim that the Commission would have publicly stated that it "would seek to restrict access by the United States and other nations to European markets for grain and rice".

    [08] Improving scientific advice on fisheries : Franz Fischler visits the International Council for the Exploration of the Sea (ICES)

    "The scientific advice provided by ICES is recognised as being objective and impartial. This is very important as this advice forms the basis of many discussions and decisions on fisheries management. Improving the quality and timeliness of scientific advice is one of the priorities in the European Commission's proposals for the reform of the Common Fisheries Policy. This is why I am here today to explore with you ways of meeting this objective. Greater cooperation between fishermen and scientists will also strengthen the reliability of scientific data. Fishermen are not only at the receiving end of scientific advice but also at its source. It is crucial therefore that data coming from the fisheries sector are reliable since good advice cannot be built up on defective bases. The Regional Advisory Committees which we propose to set up will offer an ideal forum for co-operation between you and the fishermen", Commissioner Franz Fischler, responsible for Agriculture, Rural Development and Fisheries said to representatives of ICES in Copenhagen today. The Commission will shortly present an Action Plan for the improvement of scientific advice for fisheries management.
