[I] Résultats de la Commission de ce jour - Outcome of today's Commission
meeting
[01] La Commission propose d'interdire la publicité en faveur du tabac
La Commission européenne a proposé une nouvelle directive sur la publicité
en faveur du tabac et le parrainage dans ce domaine. Cette nouvelle
proposition vise à harmoniser les réglementations existantes des Etats
membres sur la publicité en faveur du tabac en vue de stimuler le marché
intérieur. La plupart des Etats membres ont mis en place des interdictions
efficaces de la publicité en faveur du tabac. En même temps, cette
proposition cherche à garantir - comme prévu dans le traité instituant la
Communauté européenne - un niveau élevé de protection de la santé pour ses
citoyens. Ce projet de Directive interdira la publicité en faveur du tabac
dans les médias imprimés, ainsi que la publicité en faveur des produits du
tabac à la radio et sur internet. Le parrainage, par des entreprises
productrices de tabac, d'événements ou d'activités avec la participation de
plusieurs Etats membres ou à l'intérieur de plusieurs Etats membres, sera
également interdit.
[02] Commission imposes a euro 30.96 million fine on Volkswagen AG for
retail price maintenance measures on the German market
The European Commission has decided to impose a fine of euro 30.96 million
on Volkswagen AG, the biggest German, and European, car manufacturer, for
having instructed its German Volkswagen dealers in 1996 and 1997 to show
"price discipline" and not to sell the new Passat at prices considerably
below the recommended retail price. This is the second Commission decision
against Volkswagen, and follows that taken in January 1998. Measures taken
to limit discounts aim at fixing retail prices and represent a so-called
"hard core" restriction of competition. Such measures violate Article 81
(1) of the EC Treaty, which prohibits price fixing measures, and are
incompatible with the block exemption regulation applicable to motor
vehicle distribution. It is also worth noting that price comparisons over
the last few years have shown that in Germany, new car prices before taxes
for models of the Volkswagen brand are substantially higher than in all
other Member States except the United Kingdom.
[03] Commission unveils next steps towards European Research Area
(! embargo 3 pm !) The European Commission has passed another milestone in
the creation of a European Research Area with the approval of five new
research programme proposals and a new plan to support networks of national
research programmes. The euro 17,5 billion Research Framework Programme for
2002-2006 is now on schedule for operational launch in the second half of
2002. Today's proposals set out a clearer picture of the organisation,
working arrangements and priorities proposed for this new 4-year programme.
They also outline new methods of funding research.
[04] Financial services : Commission proposes Directive on insider dealing
and market manipulation
The European Commission has presented a proposal for a Directive on insider
dealing and market manipulation ("market abuse"). The proposal would
increase standards for market integrity in the securities field throughout
the EU. It is based on the principles of transparency and equal treatment
of market participants and would require closer cooperation and a higher
degree of exchange of information between national competent authorities
than currently exists. The proposal would reduce potential inconsistencies,
confusion and loopholes by establishing a basic framework for the
allocation of responsibilities, enforcement and cooperation within the
Community. The initiative is one of the centre pieces of the Financial
Services Action Plan, and the drive to create an integrated services market
by 2003. It is one of the first two proposals for Directives under the new
"Lamfalussy" Stockholm format - distinguishing framework principles from
implementing technical details (see also IP/01/759 on prospectuses). The
Commission intends to adopt technical measures to complement the framework
principles established by the Directive after consulting Member States'
representatives in a Securities Committee.
[05] Services financiers : la Commission propose un prospectus unique
valable dans toute l'UE
La Commission européenne a présenté une proposition de Directive qui
créerait un "passeport unique pour les émetteurs" : une fois approuvé par
l'autorité du pays d'origine de l'émetteur, un prospectus devrait être
accepté dans toute l'UE pour l'offre de valeurs mobilières au public et/ou
l'admission de ces valeurs à la négociation sur des marchés réglementés. Un
prospectus est un document d'information remis aux investisseurs par les
émetteurs qui souhaitent se procurer des capitaux ou faire admettre leurs
titres à la négociation. La Directive proposée simplifierait et
améliorerait considérablement tout le système de prospectus, de sorte qu'il
deviendrait plus facile et moins coûteux de lever des capitaux dans l'UE.
Cette initiative est l'un des éléments clés du plan d'action pour les
services financiers, qui vise à la création d'un marché intégré de ces
services d'ici à 2003. Il s'agit de l'une des deux premières propositions
de directives élaborées selon la nouvelle méthode "Lamfalussy" entérinée
par le Conseil européen de Stockholm (méthode qui consiste à distinguer les
principes-cadres des détails techniques de l'exécution - voir également le
communiqué IP/01/758 sur l'abus de marché). La Commission a donc
l'intention d'adopter des mesures techniques pour compléter les principes-
cadres définis par la directive, après avoir consulté les représentants des
Etats membres, réunis en un comité des valeurs mobilières.
[06] Billions surplus from the EU Budget 2000
The EU Budget 2000 has been closed with a total excess of revenue over
expenditure of euro 11.6 billion. Euro 1.635 billion of the surplus had
already been budgetised in the 2001 budget. Euro 2.075 billion will be used
to finance the correction of the UK rebate for the years 1997, 1999 and
2000. As a further euro 350 million are proposed to increase the payments
for the Western Balkans aid programme the amount of euro 7.5 billion will
be given back to the member states in the form of reductions of their
contribution to the 2001 budget. The European Commissioner for the Budget,
Michaele Schreyer, commented : "Such a surplus is exceptional. It reduces
the EU resources paid by Member States in 2001 from euro 90.972.068.520 to
euro 81.344.924.574. I think that this is quite good news for the Member
States".

[07] Commission clears Industri Kapital's acquisition of a controlling
stake in Telia's business armThor
The European Commission has today approved an operation by which a
subsidiary of Industri Kapital, a UK-based private equity investment firm,
acquires a controlling stake in Thor Holding AG, a wholly-owned subsidiary
of the Swedish incumbent telecommunications operator Telia AB. The
Commission assessed the impact of the transaction in Europe and found that
the operation would not lead to any competition concerns since no dominant
position would be either strengthened or created by the transaction.
[08] La Commission autorise Matsushita à acquérir le contrôle exclusif de
deux entreprises produisant des piles en Belgique et en Pologne
La Commission européenne a autorisé aujourd'hui une opération qui permet au
fabricant mondial d'équipements électriques et électroniques, Matsushita
Electric Industrial Co., Ltd. (MEI), d'acquérir le contrôle exclusif de
Philips Matsushita Battery Corporation (PMBC) et de Philips Matsushita
Battery Poland SA (PMBP). Jusqu'ici, PMBC et PMBP étaient contrôlées
conjointement par MEI et le groupe électronique néerlandais Koninklijke
Philips Electronics NV (Philips). Après avoir étudié les effets que
l'opération produirait en Europe sous l'angle de la concurrence, la
Commission a conclu que cette prise de contrôle ne poserait aucun problème.
[09] L'UE insiste auprès de l'industrie pharmaceutique pour qu'elle
fournisse aux pays pauvres des médicaments au prix le plus bas
Le Commissaire européen chargé du Développement et de l'Aide Humanitaire,
M. Poul Nielson, et le Commissaire responsable du Commerce, M. Pascal Lamy,
ont rencontré hier des dirigeants du secteur pharmaceutique européen pour
examiner les modalités de mise en oeuvre du programme communautaire
d'action concernant les principales maladies transmissibles (VIH/SIDA,
tuberculose et paludisme) adopté par le Conseil de ministres du 14 mai.
L'UE cherche, à cet égard, à obtenir le soutien de l'industrie
pharmaceutique pour l'application d'un système de "tarification échelonnée"
destiné à permettre aux pays en développement de se procurer des
médicaments essentiels au prix le plus bas possible. Cette rencontre, que
les deux parties ont décidé d'organiser dorénavant de manière régulière,
avait pour objet d'examiner les progrès des efforts déployés au niveau
mondial et communautaire pour renforcer, dans les pays en développement,
l'accès au système de santé et aux médicaments, et, en particulier,
d'étudier des propositions relatives à l'application de ce système.
[10] António Vitorino on a visit to Poland (31 May 1 June 2001)
Mr António Vitorino, Member of the European Commission responsible for
Justice and Home Affairs, arrives in Poland on 31 May 2001, for a two-day
visit, at the invitation of Minister of Internal Affairs and Administration,
Mr Marek Biernacki. The main objective of the visit is an exchange of views
with the Polish government, in light of the Polish preparations towards EU
accession in the field of Justice and Home Affairs.
[11] Anna Diamantopoulou earmarks 2003 as European Year of Disabled People -
poll shows EU citizens want more done to integrate those with disabilities
The European Commission today adopted a proposal to establish 2003 as the
European Year of People with Disabilities. Welcoming the move, which is set
to receive EU funding of euro 12 million, Employment and Social Affairs
Commissioner Anna Diamantopoulou said : "2003 must be a time for Europe to
become more aware of disability issues and to challenge the barriers that
prevent people with disabilities from fully participating in many aspects
of everyday life." The proposal for a Council decision comes on the day of
the first ever EU-wide Eurobarometer survey on attitudes towards disabled
people. The survey of 16,000 people shows that over 97% of EU citizens
think more could be done to better integrate them into society and that
three out of every five EU citizens is personally acquainted with at least
one disabled person.
[12] Le Groupe Européen d'Ethique a élu sa nouvelle présidente
Le Groupe Européen d'Ethique des Sciences et des Nouvelles Technologies
(GEE) a élu hier sa présidente Noëlle Lenoir et son vice-président Göran
Hermeren, et annoncé les sujets de ses prochains avis, à l'occasion de sa
première réunion à Bruxelles. Le mandat du GEE a été reconduit jusqu'en
2004 par la Commission européenne le 26 mars 2001 sur proposition du
Président Romano Prodi. Le prochain avis donné par le GEE portera sur deux
questions d'actualité qui soulèvent des problèmes éthiques majeurs : d'une
part, l'utilisation des cellules souches humaines et la brevetabilité des
inventions qui en découlent et, d'autre part, les "bonnes pratiques" en
matière de recherche menée dans les pays en développement.
