[01] Commission clears acquisition of joint control of UK real estate
company MEPC
The European Commission has cleared the acquisition of joint control over
UK real estate company MEPC Plc by General Electric Capital Corp (GECC),
which belongs to General Electric Co of the United States, and the BT
Pension Scheme (BTPS) after it concluded that the deal would not
significantly reduce competition in the UK commercial property market.
[02] La Commission autorise le rachat par AOM d'Air Liberté et de TAT
European Airlines
La Commission européenne a autorisé le rachat, par la compagnie aérienne
française AOM, de PAé (Participations Aéronautiques), société mère d'Air
Liberté et de TAT European Airlines. Etant donné qu'AOM est soumise au
contrôle en commun du groupe suisse SAirGroup et de la société française
Marine Wendel et que cette dernière contrôle également PAé, la seule
modification entraînée par l'opération est l'acquisition du contrôle en
commun de PAé par SAirGroup.
[03] La Commission décide de financer 21 "actions pilotes innovatrices pour
le transport combiné"
Le transport combiné consiste à assurer le transport de conteneurs et
d'autres unités de transport intermodal par la route en début et en fin de
parcours, et à utiliser le rail, les voies navigables intérieures ou les
transports maritimes à courte distance sur la partie principale du trajet.
Le programme PACT vise à faciliter le démarrage de services commerciaux
innovateurs dans le transport combiné international, et a favoriser ainsi
le développement d'un mode de transport socialement et écologiquement
durable. Les projets PACT doivent pouvoir se maintenir par leurs propres
moyens après avoir bénéficié d'une aide financière pendant une durée
maximale de trois ans.
[04] Commission paves way for more efficient water pricing
The European Commission has adopted a Communication on pricing policies to
enhance the sustainability of water resources. Water charging is a key
element of the proposed Water Framework Directive, on which the Council and
the European Parliament reached agreement on 28 June. The Directive
promotes pricing as an incentive for the sustainable use of water resources
and to recover the costs of water services by economic sector. A growing
number of stakeholders in the EU agree that it is necessary to make
existing pricing policies more efficient, and to develop common guidelines
for the use of water charging. With this Communication the Commission aims
to provoke a debate, which will result in effective implementation of the
water pricing Article of the Water Framework Directive. This will
contribute to meeting the environmental objectives of the Directive in the
most cost-effective way.
[05] Eco-points : la Commission distribuera cette semaine 1,5 million d'éco-
points, sans préjuger de l'accord éventuel au Conseil
Sur proposition de Loyola de Palacio, vice-présidente de la Commission
européenne en charge des Transports et de l'Energie, la Commission a décidé
de procéder à la distribution d'une partie de la troisième tranche des éco-
points pour l'année 2000. Cette distribution sera faite selon la clé de
répartition retenue dans la proposition de la Commission du 21 juin 2000.
[06] EU15 current account deficit euro 24.2 billion ; euro 1.5 billion
deficit on trade in services
(! embargo 12 am !) According to the latest revisions issued by Eurostat,
the EU15 external current account recorded a deficit of euro 24.2 billion
in the first quarter of 2000, as compared with a deficit of euro 6.7
billion in the first quarter of 1999 and a deficit of euro 0.4 billion in
the fourth quarter of 1999. In the first quarter of 2000 the EU15 external
balance of trade in services recorded a deficit of euro 1.5 billion as
compared with a deficit of euro 1.1 billion in the first quarter of 1999
and a surplus of euro 1.9 billion in the fourth quarter of 1999.
[07] Développement de l'utilisation de l'euro : une situation contrastée
La Commission européenne a publié aujourd'hui sa troisième note
trimestrielle (second trimestre 2000) sur le développement de l'utilisation
de l'euro. L'utilisation de l'euro dans les relations avec les
administrations continue à progresser dans la plupart des Etats
participants. A titre d'exemple, 9% des déclarations à la TVA et des
paiements à l'impôt sur les sociétés (en valeur) en France et près de 11%
des déclarations douanières à l'exportation en Belgique sont maintenant
faites en euro. Les paiements nationaux des entreprises en euro se
maintiennent à un niveau élevé en valeur (proche de 25%) et progressent en
volume pour atteindre 3,2%. Près de 23% des paiements internationaux sont
en euros (42% en valeur). Une entreprise sur deux déclare avoir commencé à
fixer des prix en euro et plus d'une sur dix, à facturer systématiquement
en euros. L'utilisation de l'euro par les particuliers a par contre
légèrement fléchi au cours du second semestre 2000, passant en volume de 2,
4% à 1,8% et en valeur de 8,9% à 6,4%.
[08] European Observatory for SMEs report - new performance figures and
reference studies for enterprise policy makers
The European Commission has released the sixth report of the European
Observatory for SMEs, an indispensable tool for enterprise policy makers,
statisticians, researchers and economists. This independent report is a
unique source of comprehensive information and data on the performance of
SMEs in the European Economic area, plus Switzerland. Its findings will
help shape enterprise policy initiatives to be launched under the
Multiannual Programme for Enterprises and Entrepreneurship (2001-2005).
[09] Discrimination fiscale : la Commission envoie un avis motivé à
l'Espagne
La Commission européenne a décidé d'adresser à l'Espagne un avis motivé
concernant le traitement fiscal d'actionnaires étrangers qu'elle considère
incompatible avec les règles du Traité CE sur la liberté d'établissement et
la liberté de circulation des capitaux (articles 43 et 56). L'envoi d'un
avis motivé constitue la deuxième étape de la procédure d'infraction prévue
à l'article 226 du traité CE. En l'absence d'une réponse qui confirme que
l'Espagne s'est conformée à l'avis motivé dans un délai de deux mois à
compter de la date de sa réception, la Commission peut décider de saisir la
Cour de Justice européenne.
[10] Assurances : procédures d'infraction contre la France concernant les
mutuelles et l'exigence d'une "fiche de commercialisation"
La Commission européenne a décidé d'envoyer un avis motivé et une lettre de
mise en demeure, au titre de l'article 228 du traité CE, à la France pour
non respect de deux arrêts de la Cour de justice européenne. Le premier
arrêt, de décembre 1999, se réfère à la transposition incomplète des
directives sur les assurances vie (92/96/CEE) et non-vie (92/49/CEE),
notamment en ce qui concerne les mutuelles régies par le code de la
mutualité. Le deuxième arrêt, de mai 2000, concerne l'obligation de
présenter une "fiche de commercialisation" lors de la commercialisation
d'un nouveau produit d'assurance en France. Dans le cas des mutuelles, si
les autorités françaises ne répondent pas rapidement à l'avis motivé, ou si
elles y répondent de façon non satisfaisante, la Commission pourrait
renvoyer l'affaire devant la Cour, en demandant à celle-ci d'imposer des
astreintes financières.
[11] Assurances : nouvelle procédure d'infraction à l'encontre de la
Belgique en ce qui concerne les accidents du travail
La Commission européenne a ouvert une nouvelle procédure d'infraction à
l'encontre de la Belgique, au titre de l'article 228 du traité CE, pour non-
respect d'un arrêt de la Cour de justice européenne. Le 18 mai 2000, la
Cour avait déclaré que la Belgique avait manqué aux obligations qui lui
incombent en vertu de la troisième directive assurance "non-vie" en
excluant les assurances "accidents du travail" de son champ d'application.
Cependant, ces risques sont couverts par la directive en question
lorsqu'ils font l'objet d'activité des entreprises privées d'assurance, en
application des règles du marché libre. Si les autorités belges ne
répondent pas dans un délai de deux mois à partir de la notification de la
lettre de mise en demeure, ou si elles y répondent de façon non
satisfaisante, la Commission pourra décider de leur adresser un avis motivé
et, si elle n'obtient toujours pas satisfaction, elle pourra renvoyer
l'affaire devant la Cour, en demandant à celle-ci d'imposer des amendes.
[12] Insurance : Commission pursues legal action against Greece over
breakdown assistance
The European Commission has decided to send a reasoned opinion to Greece
concerning restrictive rules that make it very difficult for non-Greek
insurance companies to offer breakdown assistance cover. In the
Commission's view, these rules represent a barrier to an internal market
for insurance and violate not only EU insurance rules, but also EU Treaty
rules on the freedom of establishment and the freedom to provide services.
A reasoned opinion is the second stage of the infringement procedure laid
down in Article 226 of the Treaty. The Greek authorities have two months
from receipt in which to confirm that they have remedied the violation of
EU law. If Greece fails to do so, the Commission may decide to refer the
case to the European Court of Justice.
[13] Public procurement : Commission refers Austria, France and Germany to
Court for failure to implement Directives
The European Commission has decided to refer Austria, France and Germany to
the European Court of Justice for failing to notify the Commission of
measures taken to implement into national law amendments to the public
procurement Directives to take account of the Government Procurement
Agreement reached in the framework of the World Trade Organisation.
[14] Terrestrial radio-broadcasting services : Commission pursues
infringement proceedings against Germany
The European Commission has decided to send a reasoned opinion to Germany
for infringing the freedom of establishment within the internal market
(Article 43 of the EC Treaty). It believes that some provisions of the
regional law of Rheinland-Pfalz and the way the authorities apply them
discriminate against EU operators wishing to engage in terrestrial radio-
broadcasting activities in that region ('Land'), and give preference to
local operators in the granting of new licences. The delivery of a reasoned
opinion is the second stage of the infringement procedure provided for
under Article 226 of the EC Treaty. In the absence of a reply showing that
Germany has complied with the reasoned opinion within a period of two
months from the date of receipt, the Commission may decide to take the
matter to the European Court of Justice.
[15] TVA : la Commission envoie des avis motivés au Royaume-Uni, à
l'Espagne, à la France et aux Pays-Bas
La Commission européenne a décidé d'envoyer des avis motivés au Royaume-Uni,
à l'Espagne, à la France et aux Pays-Bas pour des infractions aux règles
concernant le système de taxe sur la valeur ajoutée (TVA), et notamment la
sixième directive TVA (77/388/CEE). Ces infractions concernent les taux de
TVA sur la marge des commissaires priseurs (RU), le gaz liquéfié du pétrole
en bouteille (Espagne), le gaz et l'électricité (France) et l'eau (Pays-
Bas). L'envoi d'un avis motivé constitue la deuxième étape de la procédure
d'infraction prévue à l'article 226 du traité CE. En l'absence d'une
réponse qui confirme que l'Etat membre en question s'est conformé à l'avis
motivé dans un délai de deux mois à compter de la date de sa réception, la
Commission peut décider de traduire l'Etat membre devant la Cour de Justice
européenne.
[16] Waste : Commission acts against Germany, Austria and Belgium
The European Commission has decided to issue Reasoned Opinions (second
warning letters) to Germany, Austria and Belgium for their failure to apply
EU waste definitions and waste lists in national law correctly.
[17] Shellfish and surface water : Commission moves against UK and Italy
The European Commission has decided to refer the United Kingdom to the
European Court of Justice for its failure to ensure compliance with the
Shellfish Waters Directive. The UK has not designated enough areas as
shellfish waters, nor has it drawn up the necessary programmes for cutting
pollution in these waters. The Commission also referred Italy to the Court
for its failure to comply with the Surface Waters Directive. Italy has not
drawn up an action programme, as required by the Directive, for the region
of Lombardy.
[18] Chris Patten on sentence against Serb journalist Miroslav Filipovic
The European Commissioner for External Relations Chris Patten made
yesterday the following statement : "I deplore and am deeply shocked by the
sentence handed down by a military court in Serbia, following a closed
trial, on the respected European Internet Journalist of the Year, Miroslav
Filipovic. This was a show trial, with one purpose only : to intimidate the
free press in Serbia and to hide from its people what is really happening
to their country. Only a cowardly regime behaves like this. I join with
others in calling upon the judges who consider Mr Filipovic's appeal to
behave with more integrity than the court which passed this sentence. I
reaffirm the commitment of the Commission to stand by Serbia's brave
independent journalists in their hour of need.
[19] Commission supports strengthening of Palestinian Statistical System
Chris Patten, European Commissioner for External Relations, has signed a
Financing Agreement amounting to euro 2 million to support the Palestinian
Authority in strengthening the Palestinian Statistical System by supporting
the Palestinian Central Bureau of Statistics (PCBS). The grant will be
directed specifically to consolidate the national statistical information
system in order to provide relevant, reliable and timely data on the
Palestinian economy, especially in the fields of price statistics,
agriculture, trade, tourism and business. This will allow the increase and
improve the use of statistics in national policy making, planning,
monitoring and good governance. The project will be implemented over the
course of three years. It will cover technical assistance provided by EU
experts, as well as the costs of training, seminars and international
visits, plus the payment of local costs, including salaries. The EU support
to the Palestinian Central Bureau of Statistics is fully in line with the
Interim Association Agreement on trade and cooperation between the EU and
the Palestinian Authority signed on 24 February 1997. In accordance with
the development strategy agreed with the Palestinian Authority, the EU aid
is primarily directed to infrastructure and natural resources management,
institutional capacity building and private sector development.
[20] Accession of Laos and Cambodia to EU-ASEAN Agreement signed
European Commisioner for External Relations Chris Patten and French
Cooperation Minister Josselin on behalf of the Presidency signed today in
Bangkok, together with all ASEAN Foreign Ministers (except Burma), the
protocols on the accession of Laos and Cambodia to the EC-ASEAN Agreement.
Mr Patten declared at this occasion : "I very much welcome today's
signature ceremony. It is the conclusion of our negotiations for a
significant extension of one of the EU's longest-standing relationships.
The EU-ASEAN agreement will be complementary and mutually reinforcing with
our bilateral relationships with Laos and Cambodia. The Protocols will
allow both countries to benefit now also from economic cooperation and
other programmes provided under the EU-ASEAN Agreement. It is important
that Ministers will give new a impetus to EU-ASEAN relations at the
Ministerial Meeting later this year in Vientiane, by deciding on new ways
to strengthen it."
[21] Pascal Lamy in Indonesia
The European Commissioner for Trade Pascal Lamy met with Indonesian
President Abdurrahman Wahid, Coordinating Minister for Economics, Finance
and Industry, Mr Kwik Kian Gie and Minister of Industry and Trade, Mr Luhut
Pandjaitan during his visit to Jakarta on 27-28 July 2000.
