One position was that the presidential decision should be suspended and challenged from the legal-formal aspect, and the other was that the RS Constitutional Court was not authorised to assess the presidential decision since it was a separate act. The representative of the RS Government and National Assembly, Radomir Lukic, believed that by the decision dismantling RS Assembly and scheduling new parliamentarian elections for September 1, as well as by allegations that this decision took effect instantly upon issuing, president Plavsic blatantly violated the RS Constitution. According to him, RS president violated the hearing procedure, asking for a faxed opinion from the president of the National Assembly and prime minister, thus cutting short the deadline for their response from 48 to 17 and a half hours. The representative of the RS President, lawyer Milan Trbojevic, whose opinion was shared by Zdravko Zlokapa and Petar Kunic, both professors from the Faculty of Law in Banjaluka who attended the debate as scientists, believed that the RS Constitutional Court overstepped its mandate when considered a separate act by the RS president. Trbojevic added that Lukic could not represent National Assembly, which was dismissed by this act, but could represent the Government as its member (deputy foreign minister). Contrary to all these positions, prof.. Kosta Cavroski, believed that the RS Constitutional Court, which regulations and orders are obligatory for all, was mandated for assessment of the lawfulness of separate acts by the RS president. The president of the RS Constitutional Court, Gaso Mijanovic, convened consultations and voting for this evening, which will be continued tomorrow morning at 10:00 hrs, but he could not specify the time of the announcement of the decision on lawfulness of the RS presidential order.SARAJEVO - The RS Government expressed its concern over decision of RS president Biljana Plavsic of August 5 to extend OSCE Mission mandate beyond the local elections in September. An announcement issued by the Government reads that president Plavsic signed an agreement prolonging the OSCE mandate to the parliamentarian elections scheduled for October 12. The Government believes that the scheduling of the elections before the Constitutional Court brings a final decision on the constitutional dispute represents a direct violation of the RS Constitution. It reminds that it is still uncertain whether over 3,000 voters in Brcko and thousands of Serb refugees voters in other cities in RS will be allowed to vote, and that final voters lists have not been published yet. SARAJEVO - The RS Government announced that RS president Biljana Plavsic misinformed the public by her claims on alleged non-cooperativeness of the RS Ministry of Internal Affairs (MUP) in the implementation of the Dayton agreement, stated regarding the issuing of identity cards to returnees from B-H Federation to Brcko. "Having in mind a possibility of unfavourable solution for Brcko, president Plavsic blamed the MUP, especially its minister Dragan Kijac, last night on the Serb TV, thus provoking confusion in the public", says the Government. BRCKO - The controls of the MUP special units bases in the SFOR North Division zone of operations and in other places in RS were carried out without problems, and SFOR did not discover undeclared or unpermitted arms, stated the MUP Anti-Terrorist Unit commander, major-general Goran Saric and the "North" Division commander general David Grage at a press conference upon the inspection of the special police base in Brcko. Confirming that controls were carried out orderly and that no irregularities were discovered, general Grage thanked to major-general Goran Savic and RS authorities for cooperation. BRCKO - A mass and uncontrolled return of the Muslims to Brcko and their threats to local residents caused fear and deterioration of the security situation, which induced residents of Brcko bordering communities to ask for an urgent and concrete help from municipal and Republic authorities. While warning Brcko mayor Miodrag Pejic and his assistants of a prevailing psychological tension and dissatisfaction in the area, a delegation of Serb residents presented several concrete examples of returns being allowed even to the Muslims who did not live in the area before the war. SFOR also joined the intimidation campaign against Serb residents, allegedly training war crimes suspects arrests, by using tanks and aircraft. SARAJEVO - The member of the Steering Board of the B-H Central Bank, Manojlo Djoric, explained that the operations of the Central Bank would be decentralised by way of establishing a part of its administration in Pale in RS and the other in the B-H Federation in Sarajevo. The other relevant provision on the Law on Central Bank is the control of commercial banks. "Both RS and B-H Federation insisted that the Central Bank controls the commercial banks, issues permissions for their operations and regulates operations with abroad", Djoric explained, and added that the issuing of a new currency based upon foreign currency coverage will be the mandate of this institution only. CLEVELAND - US generals, Vesly Clark, Eric Shinseki and John Shalikashvili and the State Department diplomats comprise a team designated for a more aggressive implementation of the Dayton Agreement, stated the former US envoy for the Balkans, Richard Holbrooke.
