  • [01] DEMOCRACY RESPONDS WITH A FAIR TRIAL With a fair trial, democracy is responding to all those who tried, for 27 years, to destabilize it, with dozens of killings and robberies. I enter the courtroom with the presumption of innocence in hand, stated court President, M. Margaritis. Suspected op erational leader of N17, D. Koufontinas, is entering with references to the trials of Greek revolutionary heroes and of the civil war. Issues of judicial responsibility and televised coverage of the trial will be set to the court. The government has given

its assurance that all measures have been taken for coverage of the trial. Nineteen defendants, a case brief of 50,000 pages, and an estimated trial duration of 6 months.

  • [02] KARAMANLIS-ND AHEAD IN POLLS New Democracy holds a lead of approximately 8 points over PASOK according to an ALCO poll published in the "Apogevmatini" newspaper. One out of seven would not take a position on the issue, the KKE is above 5% and the Coalition above 3%, guaranteeing its parliamentary presence. Mr. Karamanlis is considered most suitable for Prime Minister, with a lead of approximately 2 points over Mr. Simitis, whose most suitable successor, according to the poll, is G. Papandreou.
  • [03] EDUCATION SUMMIT MEETING A unanimous proposal for the incorporation of Education issues in the Agenda of the Spring Summit Meeting was made to EU leaders by the informal meeting of EU Ministers of Education, which was held in Athens. During the meeting, special attention was paid

to the use of new technologies in education, the so-called "electronic enlightenment", and the need for cooperation in the "know-how" sector was stressed.

  • [04] AEK COACH'S LIFE THREATENED BY TEAM FANS The threats against the life and family of AEK coach D. Bajevic by organized AEK fans, are the new icing on the cake of Greek football, just nine rounds before the championship finals, which is more eventful in the courtroom than on the courts. AEK is in third place after PAOK's tie with Akratitos. PAO and Olympiakos have the first two places.
  • [05] "THE TRIAL OF THE CENTURY" BEGINS... The "mother of all trials" began this morning at 9am, with suspected leader of "November 17" Alexandros Giotopoulos, suspected operational leader Dimitris Koufontinas, and suspected members Savvas Xeros and Aggeliki Sotiropoulou facing a mountain of charg es, while approximately 500 witnesses will testify in the trial. Shortly after the beginning of the trial, Minister of the Press Christos Protopapas said that "the trial of N17 is being carried out in complete transparency and in a state complete information", in statements to Mega TV, while he pointed out that there w ere several improvements to the conditions under which journalists were to cover the trial. Those include permission to use mobile phones, an increase in the number of available telephones within the courthouse, and the providing of a direct telephone lin e, necessary to journalists working in radio stations. Concerning the overall trial, he pointed out that the law proposed by PASOK, but also voted for by ND, is being applied. The trial has attracted the interest of international organizations and foreign

press services, including the Associated Press, Reuters, BBC and "Le Monde", which are present and covering the trial. Security measures are extreme, as was expected, while any car coming within 500 meters of the courthouse is searched thoroughly by special canine police units. Cameras have been installed within the courtroom, while its bulletproof windows have been insta lled. The charges According to the ruling of the Appeals' Council, Alexandros Giotopoulos is considered the instigator of all the organization's actions and has been indicted for approximately 1000 crimes. Among others, he is accused of being an accessory in 6 murders, one

attempted murder, one bombing, one attempted bombing and two robberies. Dimitris Koufontinas is implicated as the perpetrator or an accessory in 84 cases, Savvas Xeros in 78, while both have been charged with more than 200 crimes and according to the indictment they are responsible for most of N17's killings. "The historians of the future will place this trial next to those of the fighters (for the liberation of Greece from Ottoman rule) of 1821, next to the trials of the communists during the civil war, next to the mass trials of the fighters against the junta". "It is ridic ulous to talk of fair trials, just of convictions of innocent and guilty parties alike. Convictions that have already been announced", underlined Dimitris Koufontinas in statements to the "Eleftherotypia" newspaper. Finally, the only woman of the organization, Aggeliki Sotiropoulou, has been indicted as an accessory to the murder of Steven Saunders and the 2002 bombing in Piraeus harbor. The witnesses In total 334 witnesses have been subpoenaed by the prosecution, eyewitnesses and non, victims or relatives of victims called by the DA to speak on each separate case. They include 29 Americans, 7 Turks, 2 Germans and 7 of other nationalities. The cases will be tried chronologically depending on when the crimes were committed, starting with the attempted murder of US Seargeant Robert Chad, which took place on April 3, 1984. Robert Chad will also be the first witness to be called to testify agai nst "N17". It should be noted that two witnesses will testify in a special room over the courtroom, in the framework of the new anti-terrorism law, since they do not want their identities to be made known. On the other hand, more than 150 defense witnesses are expected to be called during the trial, most of whom are friends or family members of the defendants. Specifically, approximately 20 people will support Alexandros Giotopoulos, including his companion

Marie Peinot, Polytechnic School Professor Venios Aggelopoulos, as well as academicians and friends of his from Paris. Thirty people are expected to defend Theologos Psaradelis, among which are French EuroMP Alain Crivin, who has known him since 1972, and Professor of Patra University Giannis Papamichael. Giannis Serifis is also expected to receive a lot of supported in the courtroom, as former Minister of Justice Evaggelos Giannopoulos expressed his willingness to attend as a defense witness. Finally, journalist Maria Gerogianni and Makis Servos, of the Network for Civic Rights, are two of Savvas Xeros' defense witnesses. Defense attorneys are expected to pick from three lines of defense: Denial of participation, refutation of initial testimonies or honest remorse for their actions. At the same time, the trial has attracted the interest of more than 30 international organizations, many of which are expected to attend the trial as observers. Those include the "Rights' Union" and "Young Attorneys", from France.

  • [06] MOUNTAIN OF CHARGES, RAIN OF OBJECTIONS The defense attorneys of the "November 17" terrorist organization suspect members are expected to file several objections concerning the publicity of the trial, the pertinence of the court, the invalidity of the preliminary examintion and the selection of

the judges, as was announced prior to the beginning of the trial. Specifically, the objections will concern, among other things, the recent law forbidding radio and television coverage, which was characterized as unconstitutional by the defense attorneys, as, in their opinion, it limits the right of publicity. In order for the court to decide on the radio and television coverage of the trial, there must be consent from all the participants of the trial. The law will be put into effect and the cameras will stay outside the courtroom if even one of the trial part icipants refuses to allow television coverage. Another objection will concern the pertinence of the court, with the rationale that this is a political trial, as it concerns political crimes and not common criminal law, and as such should be tried by a 7-member Joint Grand Jury.

Objections on the invalidity of the preliminary examinations will also occupy the court, as will objections on the placing of bulletproof glass in front of the area to function as a stand for the 19 defendants. There is also the issue of the selection of judges in the trial. Specifically, according to law 3090 of November, which was passed specifically for this trial, selection was random by means of a lottery, but after a preselection. Initially, there were 345

eligible judges, of whom 30 were preselected to participate in the lottery. The other 315 were excepted either due to work overload, or because they were going to retire shortly, or due to health problems. All 200 judges who claimed to be facing health p roblems will be required to supply evidence of those problems. Concerning the radio and television coverage of the trial, the board of the Journalists' Union met with the President of the court M. Margaritis this morning. Immediately following their meeting, Union President Panos Sobolos stated that several of the pr oblems journalists were facing have been solved, however the issue of the trial's television coverage is still unsolved. Despite the several options presented to the President of the court concerning television coverage, he did not take a position on the issue. Nonetheless, President of the court Michalis Margaritis has made an excellent impression on observers and participants in the trial with his organization, self-control and sense of humor. "The President is directing the case very wisely and humanely", stated former Minister of Finance Giannis Paleokrassas, who was present at the courtroom to file a lawsuit in the case. Earlier, Athens Mayor Dora Bakoyanni, whose husband fell victim to N17, and her daughter, also filed a lawsuit, but did not wish to make any comments. The widow of N17 victim British Brigadier Steven Saunders also arrived at the courthouse shortly after 11, in order to attend the trial. Meanwhile, the suspected leader of N17, Alexandros Giotopoulos, was isolated and silent during the beginning of the trial this morning. Although all the defendants are talking with each other, none have talked with Giotopoulos, who has been seated alone o n the third row of seats in the glass cage. Giotopoulous is facing 1000 charges, while all N17 suspects are facing a whopping total of 2000 charges.

  • [07] OBJECTIONS ON GLASS CAGE The removal of the glass cage in which the 19 defendants in the "November 17" trial have been seated was proposed by court DA Mr. Lambrou. He pointed out that if the court was to decide in favor of the proposal, the trial would have to be interrupted for a few days. The proposal had been proceeded by objections from Giannis Rachiotis, attorney of suspected leader of N17 Alexandros Giotopoulos, and Spyros Fytrakis, attorney of Giannis Serifis. The attorneys supported that the glass construction is insulting to their clients and that it is causing hindrances in communication. Specifically, Mr. Rachiotis made mention of a trial with special effects. Protests concerning the glass security cage were also made by Giannis Serifis and Dimitris Koufontinas, when the trial was resumed at 12:30 after a 30 minute recess, who insisted that it be removed, as did his attorney, Mrs. Ioanna Kourtovic. Both stated that the glass presented difficulties in communication and was insulting to the defendants.
  • [08] DA ASKS FOR INTERRUPTION DA Lambrou asked for the interruption of the trial of the "N17" suspect members for a few days, so that the defendants may be briefed on the case of Anestis Papanastasiou, the last defendant in the case. He stressed, however, that Papanastasiou's case mus t be tried along with the others, something that will happen. The second DA, Vassilis Markis, made mention of a technical issue and estimated that copies of Papanastasiou's case brief can be delivered to the attorneys tomorrow. Meanwhile, the objections by defense attorneys on the glass cage in which their clients have been seated was sustained by the President of the court, Michalis Margaritis, who ordered the sides of the cage be removed so that the defendants can communicate with their attorneys. Meanwhile, on the issue of coverage of the trial, former Minister of Justice Michalis Stathopoulos stated that the one participant's veto on the coverage of the trial can only apply for himself. He cannot obstruct the transmission of another defendant's t estimony if he is not involved in that testimony.

Specifically, New Democracy got 38.3%, PASOK 30.8%, the Greek Communist Party 5%, Coalition of the Left 3.1%, Democratic Social Movement 1.8%, and LAOS 1.5%, while 13.8% of those who responded to the questionnaire were undecided. Responding to the question, who is the most fit to be a Prime Minister, 34.4% said ND leader Kostas Karamanlis and 32.8% current Prime Minister and PASOK leader Kostas Simitis. Regarding the degree of support, coming from their own followers, enjoyed by the Greek political parties, PASOK got 74.6%, New Democracy 89.8%, the Communist Party 83.7%, Coalition of the Left 73.8%, and Democratic Social Movement 51.6%. Also, 55.5% believe that New Democracy will be the winner in the next elections compared to PASOK's 24.4%. • [12] PROTOPAPAS: FAIR TRIAL FOR THOSE ACCUSED OF BEING 17N MEMBERS The main issue is the essence of the trial of those accused of being members of the terrorist group "17 November", stated Greek government spokesman Christos Protopapas. Responding to questions by reporters, he said that this is a very important moment f or the country and the Greek society. Mr. Protopapas said that the Greek people and the country were plagued for 30 years by the actions of terrorist group 17N and those accused of taking part in its unacceptable actions are led to a fair trial. He also added that it will be finally revealed who were responsible for each terrorist act. He said that the trial is held within the framework of the penal procedure under the terms provided by the law. Mr. Protopapas stated that it is reasonable for these people to be tried by a penal court because they planted bombs and killed innocent people, they violated every sense of human dignity, they terrorized, and they robbed banks. It is a trial for crimes, he said characteristically and added that terrorism in Greece has suffered a heavy defeat with the arrest of 17N members and members of other terrorist groups as well.
