[01] La modification de la proposition de règlement sur les litiges
transfrontaliers est un élément clé de la réalisation d'un espace
européen de justice
La Commission européenne a adopté une proposition modifiée de règlement
sur la loi applicable aux obligations non contractuelles ("Rome II"). Cette
proposition est centrée sur la question de la responsabilité civile en
cas de dommages causés à autrui, notamment en cas d'accidents tels que des
accidents de la route ou des accidents causés par un produit défectueux.
Avec l'accroissement des échanges et des déplacements à l’intérieur de
l'Union européenne, les litiges de cette nature se multiplient. Bien que
la proposition ne prévoit pas l'harmonisation de la substance des lois
nationales, son but est d'assurer que les tribunaux de tous les Etats
membres appliquent la même loi en cas de litige transfrontalier portant
sur une obligation non contractuelle, en facilitant ainsi la reconnaissance
mutuelle des décisions de justice dans l'UE. Les règles proposées par la
Commission respectent un équilibre raisonnable entre les intérêts des
parties à un litige transfrontalier.
[02] Avian influenza : Standing Committee gives favourable opinion to two
Commission measures
The European Commission draft decisions on avian influenza to approve co-
funding for national surveillance plans and to ban imports of untreated
feathers from third countries received favourable opinions from Member
States in the Standing Committee on the Food Chain and Animal Health
(SCFCAH) today.
[03] Avian influenza H5 confirmed in swans in Austria : authorities
applying precautionary measures
The Austrian authorities have informed the European Commission on 14
February of a confirmed case of the H5 avian influenza virus in two dead
swans found in the region of Stiria, near to the city of Graz. Further
tests will now be carried out by the Community Reference Laboratory in
Weybridge to determine whether it is the same H5N1 strain which has been
found in wild birds in Greece, Italy, and Slovenia over the past week. The
Austrian authorities have already assured the Commission that they will
immediately apply the same precautionary measures as those already in place
in Greece, Italy and Slovenia. The Commission has adopted the same decision
for Austria, setting out interim protection measures in relation to cases
of highly pathogenic avian influenza in wild birds in Austria. The avian
influenza situation in all affected countries will be reviewed by the
Standing Committee on the Food and Chain and Animal Health which meets
today and tomorrow.
[04] Avian influenza H5N1 in swans in Germany : authorities applying
precautionary measures
The German authorities informed the European Commission last night of cases
of the H5N1 avian influenza virus in dead wild swans found on the island of
Rugen in the Baltic Sea. Samples will be sent to the Community Reference
Laboratory in Weybridge for further tests. The German authorities are
applying the same precautionary measures as other Member States in which
the H5N1 virus has been confirmed in wild birds by Weybridge (Greece,
Italy) or in which it is strongly suspected (Slovenia, Austria). The
Commission will adopt today a decision setting out the precautionary
measures to be taken in Germany, just as it did for the other affected
Member States. The avian influenza situation in all affected countries will
be reviewed by the Standing Committee on the Food and Chain and Animal
Health which meets today and tomorrow.
[05] Commission issues nuclear safeguard obligations warning to British
Nuclear Group Sellafield
The European Commission has today issued a formal warning against British
Nuclear Group Sellafield (BNG SL). Under the Euratom Treaty, the Commission
has the task of ensuring that accounting and administrative procedures are
in place to ensure that nuclear materials in possession of companies
operating nuclear facilities in the EU are not diverted from the peaceful
uses for which they have been declared.
[06] La simplification des échanges de produits agricoles transformés
entre l'UE et la Suisse stimule les exportations de l'UE
Un nouvel accord bilatéral concernant les échanges UE/Suisse de produits
agricoles transformés est entré en vigueur le 1er février 2005. De ce
fait, les exportations UE de produits agricoles transformés vers la Suisse
ont augmenté de 10% en volume et de 6% en valeur au cours de l'année
passée. Il y a un an, l'UE a supprimé les restitutions à l'exportation et
les droits à l'importation pour la plupart des produits agricoles
transformés. La Suisse a réduit et, dans de nombreux cas, éliminé les
restitutions à l'exportation et les droits à l'importation. En outre,
toutes les boissons alcoolisées – en dehors du jus de raisin avec
addition d'alcool – bénéficient, depuis le 1er février 2006, du
régime de libre échange entre les parties.
[07] Commission appoints new Director-General of the European Anti-Fraud
Office (OLAF)
On 14 February, Mr Franz-Hermann Brüner was appointed Director-General of
the European Anti-Fraud Office. Mr Brüner will be responsible, in full
independence, for the investigative activity of the Office. Under the
supervision of the Commissioner responsible for the protection of the
European Union's financial interests, he will manage the Office's
contribution to the design of the Commission's anti-fraud strategy as well
as providing assistance to the Member States by organising close and
regular cooperation between their competent authorities in order to
coordinate activities aimed at protecting the EU's financial interests
against fraud.
[08] Stavros Dimas : "Giving Kyoto a Future"
In a statement to mark the first anniversary of the Kyoto Protocol, the
European Environment Commissioner Stavros Dimas said: "Climate change poses
a vital threat to the future stability and prosperity of our societies. The
Kyoto Protocol's first year in force has seen important progress towards
addressing this major challenge. In particular, the Montreal world climate
change conference in December finalised and strengthened the rulebook for
implementing Kyoto and, even more importantly, backed the EU's view that
the time has come to start discussing future global action. The battle
against climate change is winnable but with the Earth's temperature
continuing to warm rapidly – NASA says 2005 was the hottest year on
record – farther-reaching measures will be needed after the Kyoto targets
expire in 2012. Building on the success of Kyoto, the international
community must seize the opportunity of the talks starting this spring to
create a global architecture that will deliver the deep reductions in
greenhouse gas emissions necessary to keep climate change within tolerable
limits. The post-2012 arrangements need the participation of all major
emitters while taking full account of the development needs of less
developed countries. The EU is showing the way forward in addressing
climate change with practical measures such as our emissions trading scheme
and contributions such as the Commission's February 2005 paper on the
principles that should underpin the future climate regime, which proved to
be so influential in Montreal and other fora. We are determined to continue
exercising this leadership to secure a successful outcome of the
forthcoming talks."
