  • [01] Elimination of export refunds for live cattle for slaughter

    Following a vote today at the beef management committee, the European Commission will adopt a Regulation to eliminate export refunds for live cattle for slaughter. This reflects the improved situation on the EU beef market and follows growing public concern about the treatment of animals when they are shipped abroad for slaughter.

    [02] Un nouveau pas pour la libre circulation des trains sur le réseau conventionnel transeuropéen

    La Commission européenne a adopté aujourd'hui deux spécifications techniques d'interopérabilité (sous la forme d'une décision et d'un règlement) du système ferroviaire conventionnel transeuropéen qui permettront aux trains de circuler plus librement à travers toute l'Europe. Ces spécifications portent sur le bruit émis par le matériel roulant et les applications télématiques pour le fret.

    [03] Telecommunications : Commission welcomes decision of German telecom regulator to find the international calls market in Germany competitive

    The European Commission has adopted a decision under Article 7 of the EU Framework on electronic communications endorsing the findings of the German national regulatory authority responsible for telecom regulation (Bundesnetzagentur – BNetzA) that the market for international calls in Germany is effectively competitive. The market for international calls includes all calls made by residential and business customers from a fixed location in Germany to fixed phones outside the country. As a result of the Commission decision, BNetzA will no longer impose ex-ante regulatory measures on this market in Germany. In its decision, the Commission also comments on the treatment of Voice over Internet Protocol (VoIP) services.

    [04] Telecommunications : Commission approves decision of the German regulator to open up broadband markets, including very high-speed internet access (VDSL)

    The European Commission today approved the amended proposal by the German telecoms regulator Bundesnetzagentur (BNetzA) on the market for wholesale broadband access. Following serious doubts expressed by the Commission on 11 November 2005 with regard to the exclusion of VDSL from the market, BNetzA amended its proposal by including it. Broadband access or "bitstream" allows new entrants to provide their own broadband services (such as high speed internet access, internet telephony or IP television) to end-users by controlling the quality of the products to a high degree.

    [05] La Commission autorise l'acquisition de la société du Craqueur de l'Aubette et des actifs liés par Basell

    La Commission européenne a autorisé, en vertu du règlement communautaire sur les concentrations, le projet d'acquisition de la société française Société du Craqueur de l'Aubette, une usine de butadiène établie en France, et des accords correspondants avec la clientèle, par Basell Holdings B.V., société néerlandaise productrice de polyoléfines appartenant au groupe américain Access Industries. La Commission a conclu que l'opération n'entraverait pas significativement une concurrence effective dans l'espace économique européen ou une partie substantielle de celui ci et a donc autorisé la concentration.

    [06] Commission clears acquisition of Danish Elsam and Energi E2 assets by Vattenfall

    The European Commission has approved under the EU Merger Regulation the proposed acquisition by the Swedish electricity incumbent Vattenfall of certain assets, mainly power plants, from the Danish energy companies Elsam and Energi E2. The Commission concluded that Vattenfall’s entry into Danish electricity markets would not lead to a significant impediment of effective competition in the European Economic Area (EEA) or any substantial part of it.

    [07] Commission approves acquisition of car component producer Dynamitt Nobel Kunststoff by Plastal

    The European Commission has approved under the EU Merger Regulation the proposed acquisition of Dynamit Nobel Kunststoff, a German plastic automotive components company, by Plastal, the Swedish automotive component manufacturer. The transaction will not significantly impede effective competition in the European Economic Area or any significant part of it as other large and capable players will continue to compete in the market.

    [08] Commission approves acquisition of Siebel by Oracle

    The European Commission has cleared under the EU Merger Regulation the proposed acquisition of Siebel Systems Inc. ("Siebel"), a US manufacturer of customer relationship management software solutions, by Oracle Corporation ("Oracle"), the US database and application software company. After examining the operation carefully, the Commission concluded that the transaction would not significantly impede effective competition in the European Economic Area or any substantial part of it and has therefore approved the concentration.

    [09] La Commission autorise l’acquisition du contrôle en commun de Soulès par InVivo et Toepfer International

    La Commission européenne a autorisé, en application du règlement sur les concentrations de l'UE, le projet d’acquisition en commun de Soulès, distributeur français d'ingrédients non céréaliers pour l‘alimentation animale actif en France, par InVivo, union française de coopératives, et Alfred C. Toepfer International, société internationale de négoce de produits agricoles. Après examen, la Commission est parvenue à la conclusion que l'opération n'entraverait pas de manière significative une concurrence effective dans l'Espace Economique Européen ou une partie substantielle de celui-ci.

    [10] La Commission renvoie une partie de l'opération de rachat des activités tchèques et slovaques de Carrefour par Tesco à l'autorité slovaque de la concurrence et autorise le reste de l'opération

    La Commission européenne a renvoyé une partie du projet d'acquisition des activités de commerce de détail tchèques et slovaques de la société française Carrefour par la société de distribution britannique Tesco plc, à l'autorité de la concurrence de la République slovaque, suivant la demande déposée par cette dernière en vertu du règlement communautaire sur les concentrations. C'est la première fois qu'une affaire de concentration est renvoyée à une autorité de la concurrence d'un Etat membre qui a adhéré à l'Union européenne en 2004. La Commission a constaté que l'opération affectait la concurrence sur trois marchés locaux qui sont des marchés distincts à l'intérieur de la République slovaque et qui ne forment pas une partie substantielle du marché commun. Ces aspects de l'opération seront examinés par l'autorité de la concurrence slovaque en vertu du droit national. En même temps, la Commission a autorisé l'opération en ce qui concerne la République tchèque, car elle n'entraverait pas significativement une concurrence effective dans le secteur du commerce de détail tchèque.

    [11] Commission clears planned acquisition of control over Eurowings by Lufthansa, subject to conditions

    The European Commission has cleared under the EU Merger Regulation the proposed acquisition of control by German airline Deutsche Lufthansa AG over the German airline Eurowings Luftverkehrs AG and its subsidiary, the low cost airline Germanwings. The Commission's clearance is conditional upon the parties surrendering slots at Vienna and Stuttgart airports and other concessions. In light of these commitments, the Commission has concluded that the transaction would not significantly impede effective competition in the European Economic Area or a substantial part of it.

    [12] Commission clears planned acquisition of Bax Global by Deutsche Bahn

    The European Commission has cleared under the EU Merger Regulation the proposed acquisition of the US-based freight forwarding and logistics company Bax Global by the German state-owned passenger transport company Deutsche Bahn. The Commission considers that although both companies are active in the same markets of freight forwarding and logistics, the acquisition would not lead to an increase in market share sufficient to significantly impede effective competition in the European Economic Area or any substantial part of it.

    Devant les résultats positifs de l'Année européenne de l'éducation par le sport (AEES 2004) et en réponse aux attentes exprimées au cours de l'année en question au sujet de la société civile européenne, la Commission européenne a adopté une communication adressée aux institutions de l'UE et destinée à assurer un suivi approprié de cette heureuse initiative.
