  • [01] La reprise dans la zone euro prend de la vitesse

    L'économie de la zone euro se renforce avec des taux de croissance du PIB supérieurs au niveau potentiel durant le second semestre 2005. Les composantes de la croissance deviennent également plus équilibrées : la demande intérieure gagne en force grâce à une augmentation des investissements alors même que les exportations demeurent dynamiques. Le rapport trimestriel sur la zone euro, publié aujourd'hui, examine également les conséquences du vieillissement de la population pour souligner la nécessité de mettre en œuvre des politiques du marché du travail et de protection sociale viables face à l'évolution de la situation économique et démographique.

    [02] Commission launches consultations on facilitating damages claims for breaches of EU competition law

    The European Commission has published a Green Paper on how to facilitate actions for damages caused by violations of EC Treaty competition rules' ban on restrictive business practices and abuse of dominant market positions (Articles 81 and 82 respectively). Violations of these rules, in particular by price fixing cartels, can cause considerable damage to companies and consumers but numerous obstacles can hinder actions for damages by injured parties in national courts. The Green Paper identifies certain of these obstacles, such as access to evidence and the quantification of damages, and presents various options for debate for their removal. The options set out in the Green Paper would seek to ensure that companies and consumers were compensated for their losses, while avoiding vexatious claims. Comments on the Green Paper can be submitted by 21 April 2006.

    [03] Droit des sociétés et gouvernement d'entreprise : consultation sur les priorités futures du plan d'action

    La Commission européenne a lancé une consultation publique sur les futures priorités du plan d'action sur la modernisation du droit des sociétés et le renforcement du gouvernement d'entreprise dans l'UE qui avait été présenté en mai 2003 (voir IP/03/716). Toutes les parties intéressées sont invitées à répondre à une série de 14 questions sur les éventuelles priorités futures d'ici au 31 mars 2006. Un rapport de synthèse des observations reçues sera publié ensuite.

    [04] Internal market : Commission granted authority to negotiate international convention on holding securities

    The European Commission has been granted authority by the Council to open negotiations, on behalf of the EU, on part of a draft Convention aiming to make it easier to hold and transfer securities at a world-wide level. The negotiations will take place within the International Institute for the Unification of Private Law (UNIDROIT).

    Le sondage Eurobaromètre standard de l'automne 2005 est la première vue d'ensemble dont on dispose des avis des citoyens de l'UE, au terme d'une période à la fois riche en événements et difficile dans l'histoire de l'Union. La première partie de l'année a été dominée par le processus de ratification de la constitution européenne, tandis que la seconde a été marquée par le débat sur le budget communautaire.

    [06] Commission supports new developments in biotechnology

    The European Commission today presents "100 Technology offers stemming from EU Biotechnology RTD results", a catalogue of biotechnology developments arising from EU-funded research projects over the last 10 years. This guide will help to put researchers and companies in contact, hopefully leading to new and innovative products and processes based on this research. Examples featured in the catalogue include applications for food and plant biotechnology, biopharmaceuticals and biomedical technologies to support diagnostics and therapy. Each technology offer is described, including its potential for future commercial exploitation, and contact details are given for the researchers and the owners. "100 Technology Offers" is an example of how the Commission is supporting the transformation of research into innovation.

    [07] Commission acts to put an end to export refunds for live animals

    European Commissioner for Agriculture and Rural Development Mariann Fischer Boel has today announced her intention to immediately eliminate refunds for all EU exports of live cattle. The proposal reflects the improved market situation for beef in EU. It comes only two days after the EU has vowed to eliminate all exports subsidies in agriculture before the end of 2013 as part of a global deal in the current World Trade Organisations talks on promoting international trade.

    [08] La Commission va consacrer €4,5 millions à la préparation aux catastrophes naturelles en Communauté Andine

    La Commission européenne a débloqué une enveloppe d'aide humanitaire de €4,5 millions afin de poursuivre ses activités de préparation aux catastrophes en Communauté Andine. Ces crédits sont alloués par l'intermédiaire du service d'aide humanitaire de la Commission européenne (ECHO), qui dépend du commissaire Louis Michel. L'assistance fournie visera à renforcer la capacité de réponse des populations vulnérables vivant dans les régions les plus exposées aux risques de catastrophes naturelles.

    [09] Commission clears joint control of De Post-La Poste by CVC, Post Danmark and the Belgian State

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of De Post NV-La Poste SA of Belgium by Post Invest Europe SÃ rl, jointly controlled by the CVC group (CVC) of Luxembourg and Post Danmark A/S of Denmark, and the Belgian State. De Post-La Poste is the Belgian universal postal services operator. CVC is a private equity company. Post Danmark is the incumbent postal operator in Denmark. The operation was examined under the simplified merger review procedure.

    [10] Commission clears acquisition of FL Selenia by KKR

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of sole control of FL Selenia S.p.A. of Italy by Sole Italy S.Ã .r.l. of Luxembourg, ultimately controlled by Kohlberg Kravis Roberts & Co. L.P. (KKR) of the US. KKR is active in private equity investments. FL Selenia manufactures and distributes automotive, industrial and marine lubricants and systems fluids for cars and industrial vehicles. The operation was examined under the simplified merger review procedure.

    [11] Commission clears acquisition of Safic NP by E D & F Holdings

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of sole control of the Natural Products division of Safic Alcan SAS (Safic NP) of France by E D & F Man Holdings (Man) of the UK. Man is a commodities trader, engaged in the sourcing, refining, shipping, delivery, distribution and brokerage of sugar, and the supply and distribution of molasses, alcohol, coffee and cocoa, to users around the world. Safic NP is a commodities trader dealing with the distribution and trade of natural products – tropical vegetable oils, natural rubber and latex. The operation was examined under the simplified merger review procedure.

    [12] Commission clears joint venture between SAFT and JCI

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of a newly created company constituting a joint venture by Johnson Controls Inc (JCI) of the US and Saft Groupe SA (SAFT) of France. JCI is active in automotive and building control systems. SAFT's business activities are industrial and speciality batteries. The joint venture will concern batteries for hybrid and electrical vehicles. The operation was examined under the simplified merger review procedure.

    [13] Commission clears joint venture between Technip and Subsea 7

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of a newly created company by Technip S.A. (Technip) of France and Subsea 7 Pty Ltd (Subsea 7) of Singapore. Technip and Subsea 7 are both active in the engineering, procurement, construction, installation and maintenance of facilities for the subsea production and transportation of oil and gas. The joint venture will provide such services in the Asia Pacific region (except India and the Middle East), including the distribution of flexible piping. The operation was examined under the simplified merger review procedure.

    [14] Libre circulation des capitaux : la Commission demande au Luxembourg de modifier les dispositions du contrat de concession des satellites Astra

    La Commission européenne a décidé de demander officiellement au Luxembourg de se conformer au droit communautaire en ce qui concerne le contrat de concession établi avec la société de satellites SES Astra, qui lui permet de bloquer certaines prises de participation dans les sociétés SES Astra et SES Global. Elle s'inquiète de ce que ces dispositions restreignent de manière injustifiée les mouvements de capitaux et la liberté d'établissement, en violation des règles du traité CE (article 56 et 43). Cette demande de la Commission prend la forme d'un avis motivé prévu à l'article 226 du traité CE. Dans l'hypothèse où les autorités luxembourgeoises ne prendraient pas de mesures satisfaisantes dans les deux mois qui suivent la réception de l'avis motivé, la Commission pourrait décider de saisir la Cour de justice européenne.

    [15] Qualifications professionnelles : procédures d'infraction contre le Portugal, la Grèce et la France ; classement d'une procédure d'infraction contre l'Italie

    La Commission européenne a engagé des recours contre le Portugal, la Grèce et la France pour violation de la législation européenne sur les qualifications professionnelles. Le Portugal sera assigné devant la Cour européenne de justice pour ses procédures de reconnaissance des diplômes d'architecte délivrés dans les autres Etats membres et la Grèce pour ses procédures de reconnaissance des diplômes d'opticien. De plus, la Commission a décidé, au titre de l'article 228 du traité CE, d'adresser à la Grèce une mise en demeure lui demandant des informations complètes sur son exécution d'un arrêt de la Cour de justice lui enjoignant d'autoriser les personnes morales à ouvrir des magasins d'optique. Par ailleurs, la Commission a officiellement demandé à la France de modifier sa législation dans quatre cas : la reconnaissance des diplômes de pays tiers déjà reconnus par un autre Etat membre ; les conventions collectives pour la reconnaissance des qualifications de travailleur social ; la procédure de reconnaissance des diplômes d'agent immobilier acquis dans d'autres Etats membres et la prestation temporaire de services par des médecins, dentistes et sages-femmes établis dans un autre Etat membre. Ces demandes ont été adressées sous la forme d'«avis motivés», la deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. Faute de réponse satisfaisante dans les deux mois, la Commission pourra porter l'affaire devant la Cour européenne de justice. Enfin, la Commission a décidé de classer une procédure d'infraction à l'encontre de l'Italie à la suite de l'abrogation d'une disposition selon laquelle les notaires devaient avoir la nationalité italienne.

    [16] Environment : Commission pursues infringement actions against Germany

    The European Commission has decided to pursue legal action against Germany over two cases involving infringements of EU laws to protect the environment. The Commission is taking Germany to the European Court of Justice over its rules governing the use of agricultural fertiliser because they are not fully in line with the EU Nitrates Directive. In the second case, the Commission has sent Germany a final warning for not taking sufficient action to comply with a 2001 Court judgement which found that Germany had not submitted an exhaustive list of designated nature conservation sites under the EU Habitats Directive. If Germany fails to remedy this situation the Commission could take the case to Court a second time and ask the Court to impose a fine.

    [17] La Commission engage des poursuites judiciaires contre l'Allemagne et la France concernant la législation sur les biotechnologies

    La Commission européenne a envoyé des derniers avertissements écrits à l'Allemagne et à la France pour ne pas s'être conformées à des arrêts rendus par la Cour de justice européenne en 2004. Malgré l'arrêt de la Cour et les avertissements ultérieurs de la Commission, ces deux Etats membres n'ont encore adopté qu'une partie de la législation nationale mettant en application la directive relative à la dissémination volontaire d'organismes génétiquement modifiés dans l'environnement. Cette transposition devait être achevée pour le 17 octobre 2002 au plus tard.

    [18] Commission starts legal action against eight Member States over insufficient protection of whales, dolphins and porpoises

    The European Commission has launched infringement proceedings against eight member states for not adequately monitoring how effectively their populations of cetaceans - whales, dolphins and porpoises - are being protected. All cetacean species require strict protection under the EU's Habitats directive. Member states' surveillance of their conservation status is an important element in this. The Commission considers that Belgium, France, Greece, Italy, the Netherlands, Portugal, Spain and the UK have not established sufficiently effective surveillance systems. It has sent these member states a first written warning - first step in the legal procedure - that they are breaching the Habitats Directive and need to take corrective action to ensure full protection of these marine mammals.

    [19] Environment : Commission to pursue legal action against Greece over infringements

    The European Commission has decided to pursue legal action against Greece over four cases where EU rules to protect human health and the environment are being violated. The cases concern management of hazardous and non- hazardous wastes, water protection and bird conservation. In one of the cases the Commission is taking Greece to the European Court of Justice over Greece's failure to clean up an illegal waste dump in Crete. Greece has already been condemned by the Court twice over this dump, and made to pay a substantial fine.

    [20] Commission to pursue nine infringement cases against Italy over inadequate waste management

    The European Commission has decided to pursue legal action against Italy in nine cases where Italy is violating EU rules designed to protect people and the environment against potential negative effects from waste. In six of the cases, Italy has failed to comply with rulings against it by the European Court of Justice. Another case challenges Italy's recent systematic practice of defining waste more narrowly than EU law does, thereby allowing certain types of waste to escape being regulated as such.

    [21] Margot Wallström en visite au Parlement Fédéral belge

    La Vice-présidente de la Commission européenne responsable des relations institutionnelles et de la stratégie de la communication, Mme Margot Wallström, a participé aujourd'hui mardi 20 décembre à la réunion du comité d'avis fédéral chargé des questions européennes. La réunion portait entre autres sur la période de réflexion sur l'avenir de l'Union, le Plan D, et le rôle des Parlements nationaux en Europe. A ce sujet, Mme Wallström a déclaré : "Je pense que l'élément-clé c'est l'information, une information claire et opportune. Et dans ce domaine la Commission s'est engagée dans une importante mission de facilitation. Les Parlements devraient recevoir suffisamment tôt une information qui soit claire et précise de l'Union européenne. Cette démarche sera dorénavant facilitée par la publication du programme de travail dans les plus brefs délais, qui fournira une feuille de route pour chaque sujet en donnant l'information nécessaire sur la subsidiarité et notamment sur la consultation des parlements nationaux."

    [22] GDP per capita in purchasing power standards : GDP per capita in the Member States ranged from 43% to 227% of the EU25 average in 2004

    Accordint to Eurostat, GDP per capita in Luxembourg, expressed in terms of purchasing power standards (PPS), was more than twice the EU25 average in 2004, while Ireland was about 40% above average, and the Netherlands, Austria, Denmark, Belgium, Sweden and the United Kingdom around 20% above average. Finland, France and Germany recorded figures about 10% above the EU25 average, and Italy and Spain were at the level of the average. Cyprus, Greece and Slovenia were about 20% below the EU25 average. Portugal, the Czech Republic and Malta were around 30% below average, and Hungary about 40% below. Slovakia, Estonia, Poland and Lithuania were around half the average, while Latvia was just below 45% of the EU25 average.

    D'après les premières estimations publiées aujourd'hui par Eurostat, pour le mois d'octobre 2005, le solde des échanges de la zone euro avec le reste du monde a été équilibré alors qu'un excédent de €4,9 milliards avait été enregistré en octobre 2004. Le solde enregistré au mois de septembre 2005 était de +2,0 milliards, contre +2,6 milliards en septembre 2004. En octobre 2005, les exportations, corrigées des variations saisonnières, ont baissé de 2,3% par rapport à septembre 2005, tandis que les importations ont progressé de 0,9%. Les premières estimations du solde des échanges extra-UE253 pour le mois d’octobre 2005 indiquent un déficit de €11,0 milliards, contre -7,0 milliards en octobre 2004. Au mois de septembre 2005, le solde était de -8,7 milliards, contre -8,3 milliards en septembre 2004. En octobre 2005, les exportations, corrigées des variations saisonnières, ont diminué de 2,7% par rapport à septembre 2005, tandis que les importations ont augmenté de 0,6%.
