of today's Commission meeting
[01] Less red tape = more growth : Commission tables package for better
regulation
Improving the quality of regulation can significantly spur growth in the EU
economy and business. This is why "better regulation" is a centrepiece of
the European Commission's "partnership for growth and jobs". It is
essential for setting up the right conditions for growth and employment in
Europe. The better regulation package the Commission tabled today is
designed to cut-red tape, tackle excessive regulation and help to strike
the right balance between the costs and benefits of legislation.
[02] EU accounting system : reform delivers improved control
The EU is on course for a world class system of financial control, European
Commissioner for Financial Programming and Budget, Dalia Grybauskaité told
her fellow Commissioners this week. In the first report on the
implementation of the new system, she highlighted the successful transition
to a more complete and efficient accounting system, vital to ensure
effective scrutiny over spending. With the swift establishment of the new
system, the Commission will meet the highest internationally-recognised
standards for public bodies, improve the day-to-day management of funds,
and minimise the risks of error or irregularity.
[03] La Commission autorise des aides Ă l'innovation en faveur de chantiers
navals français et espagnols
La Commission européenne a autorisé, en application des règles du
traité CE régissant les aides d'Etat, des régimes d'aides respectivement
français et espagnol en faveur de l'innovation dans le secteur de la
construction navale, d'une valeur respective de 25 millions d'€ par an
pendant six ans et 20 millions d'€ par an pendant deux ans. Comme pour un
régime institué précédemment par l'Allemagne (voir IP/05/188), la
Commission est arrivée à la conclusion que les aides n'étaient pas
susceptibles de crĂ©er une distorsion de concurrence excessive Ă
l'intérieur du marché unique et qu'elles étaient par conséquent
compatibles avec les règles du traité CE régissant les aides d'Etat
(article 87) et en particulier avec l'encadrement des aides d'Etat Ă la
construction navale (voir IP/03/1607). Celui-ci a instauré des règles
révisées concernant les aides destinées à soutenir l'innovation dans le
secteur de la construction navale, conformément aux objectifs de l'agenda
de Lisbonne et plus particulièrement ceux du programme LeaderSHIP 2015
destiné à améliorer la compétitivité du secteur (voir IP/03/1464).
[04] Commission endorses €3.8 million in environmental aid to ACEA Group
in Italy, provided previous aid is recovered first
The European Commission has authorised, under the EC Treaty's rules on
state aid, environmental aid to a district heating project in Rome. However,
the Commission decided that the aid could not be granted until the
beneficiary, part of the ACEA group, has reimbursed a previous aid that the
Commission had declared illegal and incompatible in 2002 (see IP/02/817).
The Commission considered that the cumulation of the aid from which ACEA
benefited in 2002 and the new notified aid could have particularly
distortive effects.
[05] Commission endorses €18.5 million of aid to reduce mercury emissions
in Italy
The European Commission has authorised, under the EU state aid rules,
subsidies to two chlorine producers in Italy to set up new plants allowing
for mercury-free chlorine production. Solvay Rosignano is due to receive
€13.5 million aid to promote a €48 million investment, and Altair
Chimica is due to receive about €5 million for a planned €13.5 million
investment. The companies will end production based on mercury technology
and introduce so-called membrane technology for which no mercury is needed.
The Commission concluded that the aid was not likely to cause undue
distortion of competition within the Single Market and was therefore
compatible with EC Treaty state aid rules (Article 87).
[06] Commission outlaws Italian tax breaks for companies listed for the
first time on EU stock exchanges
The European Commission has decided that an Italian scheme reducing the
nominal and effective corporate tax rates of companies listed for the first
time on a regulated EU stock exchange in 2004 violates EU Treaty state aid
rules (Article 87). The decision follows an in-depth investigation opened
in February 2004. The scheme distorts competition because it is limited to
a small number of undertakings able to list within the narrow timeframe
provided for by the law (i.e. 2004) and constitutes operating aid in
favour of some of Italy's high-growth companies. The aid has been enacted
without prior Commission approval and must be reimbursed by its
beneficiaries. The Italian authorities earmarked €56 million in 2004
alone in terms of foregone tax revenue.
[07] La Commission autorise un régime d'aides belge pour la promotion du
transport combiné en région wallonne
La Commission européenne a donné son accord à un régime belge d'aides
pour la promotion du transport combiné. Ce régime sera en vigueur pendant
la période 2004-2006 avec un budget de 3 millions d'€ pour toute la
période.
[08] La Commission autorise un programme d'aides allemand pour la promotion
du transport combiné
La Commission européenne a donné son accord à un régime allemand d'aides
au transport combiné. Ce régime sera en vigueur pendant la période 2004-
2006 avec un budget de 15 millions d'€ par an. L'objectif de ce nouveau
régime d'aides est d'encourager le développement du transport combiné en
Allemagne à travers la création de nouveaux services de transport combiné
et des investissements dans les transferts de technologie.
[09] La Commission autorise le versement de €3.292.400 à la Société
Nationale Maritime Corse-Méditerranée
La Commission européenne a décidé d'autoriser le versement par la France
d'une aide de €3.292.400 à la compagnie SNCM (société nationale Corse
Méditerranée). Il s'agit de la seconde tranche de l'aide à la
restructuration que la Commission avait autorisée par décision du 9
juillet 2003. Cette décision avait déjà permis le versement d'une
première tranche d'aide de 66 millions d'€ en faveur de la compagnie.
[10] Commission authorises state aid for less favoured areas in Finland
The European Commission has authorised Finland to pay state aid worth a
total of €120.3 million per year to compensate farmers for natural
handicaps in less favoured areas. The new state aid would be combined with
existing support for less favoured areas co-financed by the European Union
(EU) in the framework of the Finnish rural development program. The aid
consists of a basic payment of 20 €/ha in support areas A, B and C1 and
25 €/ha in support areas C2-C4. This basic payment is granted for all
areas eligible for a co-financed allowance. In addition, area situated in
animal husbandry farms receives an additional payment of 80 €/ha.
[11] Commission authorises Slovakia to grant € 350.000 aid to mining
company Hornonitrianske Bane Prievidza a.s.
The European Commission has decided not to raise any objections to the
€350,000 aid which Slovakia is proposing to grant to mining company
Hornonitrianske Bane Prievidza a.s. The aid is compatible with the proper
functioning of the common market.
[12] Ouverture des marchés de l'énergie : dix Etats membres n'ont
toujours pas transposé les nouvelles règles européennes
La Commission européenne a envoyé des avis motivés à l'Allemagne, la
Belgique, l'Estonie, l'Irlande, la Lituanie, la Lettonie, la Suède, la
Grèce, l'Espagne et le Luxembourg, pour défaut de transposition dans leur
droit national de l'une et/ou l'autre des deux directives européennes
relatives au marché intérieur de l'électricité et du gaz. C'est la
seconde étape de la procédure d'infraction après l'envoi par la
Commission en octobre 2004 de lettres de mise en demeure Ă 18Â Etats. La
situation s'est donc améliorée mais la Commission regrette que dix Etats
membres n'aient toujours pas transposé les directives près de deux ans
après leur adoption en juin 2003. "Il ne suffit pas de légiférer : il
faut que les Etats appliquent les règles qu'ils se sont eux-mêmes
données. La Commission utilisera tous les moyens à sa disposition pour le
rappeler aux Etats. La législation en question représente une étape
essentielle vers la réalisation d'un véritable marché compétitif de
l'énergie en Europe et une des conditions de la réussite de la stratégie
de Lisbonne", a souligné le Commissaire Andris Piebalgs en charge de
l'Ă©nergie.
[13] Commission notifies Member States on delays in implementing European
legislation on biofuels
The European Commission issued letters of formal notice to nine Member
States that have not yet communicated their target for the share of
biofuels in 2005, as required by the European legislation on biofuels. This
legislation requires that an increasing proportion of all diesel and petrol
sold in the Member States be biofuels, starting with 2% in 2005 and
progressively increasing so as to reach a minimum of 5.75% of fuels sold in
2010. The action plan adopted in 2001 to foster the use of alternative
fuels for transport indicated that the use of fuels (such as ethanol and
biodiesel) derived from agricultural sources was the technology with the
greatest potential in the short to medium term. "The transport market is
today almost entirely dependent upon oil-based fuels", said Andris Piebalgs,
Commissioner for Energy. "It is now urgent that all Member States live up
to their commitments to develop an alternative fuel strategy for transport
and to tackle this over-dependence which is a significant source of
environmental and supply concerns for the European Union."
[14] Public procurement : Commission acts to enforce EU law in Spain, UK,
Portugal and Italy
The European Commission has decided to ask Spain for its observations on
the compatibility with EU law of the procedure used in the architectural
competition organised for the development of the Santa Catalina port in Las
Palmas, Gran Canaria. A similar letter has been sent to the UK over the way
contracts related to the design and construction of the new Scottish
Parliament building at Holyrood were awarded. Meanwhile the Commission is
asking Portugal to comply with an October 2004 judgement of the European
Court of Justice requiring it to apply correctly EU law on appeal
procedures for bidders who believe they have been unjustly treated in
tendering procedures for works and supply contracts. The Commission has
decided to refer Italy to the Court over contracts for hydraulic works in
the borough of Stintino (Sassari, Sardinia).
[15] La Commission continue ses actions contre les accords illégaux "Ciel
ouvert"
Suite aux mesures prises en juillet et décembre 2004 pour faire appliquer
les arrĂŞts "Ciel ouvert" de la Cour de Justice (IP/04/967 et IP/04/1478),
la Commission européenne, dans son rôle de gardienne des traités, a
dĂ©cidĂ© d'envoyer des lettres de mise en demeure et des avis motivĂ©s Ă
onze Etats membres disposant d'accords de services de transport aérien
avec les Etats-Unis. Tous les Etats membres disposant d'accords bilatéraux
avec les Etats-Unis (soit 20 Etats sur 25) font aujourd'hui l'objet de
procédures d'infraction. Ces accords aériens contiennent des clauses
dites 'de nationalité' qui réservent les bénéfices des accords aux
seules compagnies nationales des Etats signataires, en violation flagrante
du droit européen. La Commission prépare en parallèle la relance des
négociations avec les Etats-Unis pour la conclusion d'un accord global.
[16] Marché intérieur du transport routier : la Commission renvoie le
Portugal devant la Cour
La Commission europĂ©enne a dĂ©cidĂ© de saisir la Cour de Justice Ă
l'encontre du Portugal qui ne lui a toujours pas notifié les mesures de
transposition en droit national de la législation communautaire relative
aux poids maximaux et aux dimensions maximales autorisés pour certains
véhicules routiers, notamment les bus.
[17] Accélération des formalités applicables aux navires : la Belgique
est renvoyée devant la Cour
La Commission européenne a décidé d'engager une action en justice contre
la Belgique pour non-conformité des mesures adoptées pour transposer la
législation européenne concernant les formalités déclaratives
applicables aux navires à l'entrée et/ou à la sortie des ports des Etats
membres de l'Union européenne. "J'espère que la Belgique suivra
rapidement l'exemple des autres Etats membres afin de faciliter le
transport maritime Ă courte distance, et acceptera l'utilisation des
formulaires de déclaration normalisés", a déclaré le vice-président
Jacques Barrot.
[18] 2001 rail infrastructure package : Commission asks four Member States
to comply with the Court ruling
Following condemnation of Germany, Greece, Luxembourg, and the United
Kingdom by the Court of Justice in October 2004, the European Commission is
launching today further legal proceedings against these four Member States
for failure to comply with the judgment of the Court and to communicate
national measures for implementing the three directives of the 2001 rail
infrastructure package. The aim of this legislation is to enable the
opening of the market for international rail freight and to have more
efficient and reliable cross-border operations. The Commission will
continue to strive for a European level playing field in this area, and
wants railways to compete more effectively with road transport.
[19] Air transport security : Commission sends reasoned opinion to Greece
The European Commission has sent a reasoned opinion – the last step
before a formal complaint to the Court of Justice is lodged – to Greece
for failure to respect European legislation on aviation security. The aim
of this legislation is to develop civil aviation security through
reinforced measures including national quality control programmes.

[20] Commission approves acquisition of Veritas by Symantec
The European Commission has cleared under the EU Merger Regulation the
proposed acquisition of Veritas Software Corp (Veritas), the US storage
software company, by Symantec Corp (Symantec), the US security software
company. After examining the operation carefully, the Commission concluded
that the transaction would not significantly impede effective competition
in the EEA or any substantial part of it and has therefore approved the
concentration.

Le taux d'inflation annuel de la zone euro est passé de 1,9% en janvier
2005 à 2,1% en février 2005, indique Eurostat. Un an auparavant, il
s'élevait à 1,6%. Le taux d'inflation mensuel a été de 0,3% en février
2005. Le taux d'inflation annuel de l'UE25 a été de 2,1% en février 2005,
contre 2,0% en janvier. Un an auparavant, il s'Ă©levait Ă 1,6%. Le taux
d'inflation mensuel a été de 0,3% en février 2005. Le taux d'inflation
annuel de l'IPCE était de 2,1% en février 2005.
[22] EU-Russia deal safeguards trade in plant products
The European Commission, supported by the Luxembourg Presidency and a group
of Member States chosen by the Council, finalised on 15 March a deal
negotiated with Russia on a harmonised phytosanitary certificate for EU
exports. Russia had warned that it would close its market to all plant
products originating in the EU if a single plant health certificate for EU
exports was not introduced by 1Â April 2005. Intense negotiations have
taken place since December 2004 when the Commission got the mandate to
negotiate with Russia on behalf of the EU Member States. Both parties
agreed to continue technical discussions on the implementation of the new
certificates. A transitional period of three months was therefore agreed so
that the old and new certificates can be used in parallel.
[23] WTO Panel upholds EU system of protection of "Geographical
Indications"
A report by a WTO panel published on 15 March confirms that the EU system
of protection of geographical indications for agricultural products
complies with WTO rules. Geographical indications provide protection for
products identified with a particular geographical location, for example
Roquefort or Prosciutto di Parma. Rejecting the arguments of the United
States and Australia, the WTO ruled that the EU's system for protecting
these names is essentially compatible with WTO rules, including the
requirements of the TRIPs Agreement. The WTO confirmed in particular that
Geographical Indications can coexist with prior trademarks. The ruling
confirms the rights of the holders of Europe's approximately 700
Geographical Indications.
[24] L'Ă©nergie du futur : l'industrie de l'hydrogène et de la pile Ă
combustible présente son projet
Les 17 et 18 mars, lors de sa deuxième assemblée générale, la plate-
forme europĂ©enne pour les technologies de l'hydrogène et des piles Ă
combustible présentera ses propositions de développement à moyen et long
terme de l'hydrogène et des piles à combustible pour transporter et
convertir l'énergie proprement. L'Europe est confrontée à la fluctuation
des prix du pétrole, au réchauffement planétaire et à une augmentation
de la demande d’énergie. L'hydrogène, de mĂŞme que les piles Ă
combustible sa principale application, est maintenant largement reconnu
comme une source d'Ă©nergie flexible et respectueuse de l'environnement. En
effet, il réduit les émissions de gaz à effet de serre, améliore la
qualité de l'air à l'échelon local et renforce la sécurité de
l'approvisionnement en Ă©nergie. En tant que source d'Ă©nergie,
l'hydrogène revêt une importance particulière pour le secteur des
transports. La plate-forme, avec le soutien de la Commission européenne,
rassemble tous les acteurs clés de la filière de l'hydrogène, des
instituts de recherche aux autorités publiques en passant par les ONG. Le
16 mars, il sera possible de voir des prototypes de véhicules à hydrogène
en action, de mĂŞme qu'une exposition sur les technologies actuelles et les
projets de recherche en cours dans ce domaine.
