[01] New legislation to crack down on rogue traders : EU-wide enforcement
network given green light
European Commissioner for Health and Consumer Policy David Byrne welcomed
the final adoption on 7 October of a new EU law to help prevent
unscrupulous traders evading consumer protection authorities by targeting
consumers living in other EU countries. The Council of Ministers formally
approved legislation to create an EU-wide network of national enforcement
authorities capable of taking coordinated action against rogue traders who
abuse the freedom of the EU's Internal Market in order to run cross border
scams. The new law, which was initially proposed by the European Commission
in July 2003 (see IP/03/1067), will remove barriers to information exchange
and cooperation. It also empowers enforcement authorities to seek and
obtain action from their counterparts in other Member States. Adoption of
the new law was made possible by a political agreement on the legislation
reached earlier this year between Parliament and Council (see IP/04/655).
The new EU-wide enforcement network will start work in 2006.

Le statut de la société européenne peut en principe être utilisé Ã
partir du 8 octobre 2004, c'est-à -dire plus de trente après qu'il a
été proposé pour la première fois par la Commission. Une directive
connexe concernant la participation des travailleurs des sociétés
européennes est entrée en vigueur simultanément. Toutefois, seuls six
des vingt-huit Etats membres de l'UE et de l'EEE ont adopté les
réglementations nationales nécessaires pour permettre la constitution de
sociétés européennes sur leur territoire. Jusqu'à ce que les autres
aient fait de même, de nombreuses sociétés opérant dans plus d'un Etat
membre n'auront pas la possibilité de se constituer en société de droit
communautaire et d'évoluer comme un opérateur unique dans toute l'UE en
appliquant un jeu unique de règles, une direction unique et des règles
publicité uniques.
[03] Commission clears joint acquisition by International Power and Mitsui
of EME's power projects portfolio
The European Commission has granted regulatory clearance, under the Merger
Regulation, to a proposed concentration by which British power generator
International Power plc and Japanese trading company Mitsui & Co., Ltd.
acquire joint control over the international generation portfolio of Edison
Mission Energy (EME, UK) by way of purchase of 100% of the issued share
capital of MEC International BV (NL). MEC is currently a wholly-owned
subsidiary of EME. (The transaction, which was notified on 03.09.2004, was
examined under a simplified procedure)

Le premier registre sur internet des émissions industrielles dans l'air et
l'eau a été lancé en février dernier par la Commission européenne et
l'Agence européenne de l'environnement. Ce registre a été un immense
succès, avec plus de 100.000 visiteurs au cours des trois premiers mois.
La Commission propose aujourd'hui de constituer un registre encore plus
exhaustif, le registre européen des rejets et des transferts de polluants
(PRTR). Ce registre contiendra davantage de données et des informations de
meilleure qualité ; il portera sur davantage de polluants, de sources
industrielles, de types d'émissions, et sera mis à jour chaque année. Il
satisfera ainsi encore mieux les besoins des utilisateurs, y compris le
public, déjà très nombreux avec la première version.
[05] Social partners in cooperation to combat work-place stress
(! embargo 2 pm !) Today, the four major European social partner
organisations signed a framework agreement on work-related stress, an issue
which is a concern for both employers and workers. The agreement was then
presented to the European Commission. This agreement, concluded after nine
months of negotiations, is to be implemented by the members of ETUC,
UNICE/UEAPME, and CEEP, rather than by European legislation.
The ceremony will take place at 14h00 in room 11A in the Breydel building,
avenue d'Auderghem.
[06] Locust plague in West Africa : Commission allocates over €25 million
to combat infestation
The European Commission has allocated €25.5 million to combat a locust
plague currently blighting West Africa, thereby more than doubling the
total aid so far granted by international donors in response to this
plague. This emergency aid will buy pesticides, provide transport, train
staff and offer the technical assistance needed to protect crops and food
supplies. This is a priority of EU support to the five West African
countries concerned - Chad, Mali, Mauritania, Niger and Senegal. The
programme will also prevent the plague from spreading to neighbouring
regions. The UN's Food and Agricultural Organisation (FAO) will draw on its
long-standing experience to implement the programme. By systematically
destroying empty pesticide drums and obsolete supplies, and funding trials
of new techniques, the EU's programme is designed to minimise the impact on
human health and the environment and strengthen existing prevention
measures.

The 2004 Autumn Report ("The euro area and the Lisbon Strategy") of the
European Forecasting Network (EFN) is published today on the following web-
site: <a href="http://www.efn.uni-bocconi.it/reports.htm">www.efn.uni-
bocconi.it/reports.htm. Although the Commission has co-financed the report,
the analysis and the forecasts remain the sole responsability of the EFN.
