MIDDAY EXPRESSNews from the Press and Communication Directorate General's midday briefingNouvelles du rendez-vous de midi de la Direction Général Presse etbCommunication16/07/04[01] Commission claws back €143.86 million of CAP expenditure from the Member States€143.86 million of EU farm money misspent by Member States will be claimed back, following a decision adopted by the European Commission today. The money is to be recovered because of inadequate control procedures or non-compliance with EU rules on agricultural expenditure. While Member States are responsible for paying out and checking virtually all expenditure under the Common Agricultural Policy (CAP), the Commission is required to ensure that Member States have made correct use of the funds.[02] EU eases food imports from China after significant improvements in veterinary standardsThe Member States meeting in the Standing Committee on the Food Chain and Animal Health agreed on a European Commission proposal to authorise the import from China into the EU of shrimps, farmed fish, honey, royal jelly, rabbit meat and a number of other products of animal origin. Exporters will have their products checked by the Chinese food safety authorities and each consignment will be certified as meeting the relevant EU food safety standards. In January 2002 imports of all products of animal origin from China were stopped because the EU considered China's system to control residues of veterinary medicines in farmed animals to be too lax. China has since then made considerable progress in tightening its food and feed safety controls. The 2002 ban was partially relaxed last year with positive results and the Commission is confident that, provided proper controls continue, imports of these other animal based products from China can now safely be allowed. Nonetheless, the Commission still has concerns about the safety of chicken and other poultry meat from China – particularly given the recent re-emergence of avian influenza in East Asia. The EU's ban on the import of poultry products from China will therefore remain in place.[03] Qualifications professionnelles : procédures d'infraction contre le Luxembourg, le Royaume-Uni, l'Allemagne, l'Autriche et le PortugalLa Commission européenne a demandé formellement au Luxembourg de supprimer le contrôle linguistique qu'il a introduit pour l'établissement des avocats, ce qui est incompatible avec la directive 98/5/CE, qui permet à un avocat de s'établir dans un autre Etat membre et de pratiquer le droit du pays d'accueil. Cette demande prend la forme d'un avis motivé, la deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. Si un Etat membre qui a reçu un avis motivé ne donne pas de réponse satisfaisante dans le délai fixé (généralement deux mois), la Commission peut saisir la Cour. La Commission a également décidé de traduire le Royaume-Uni devant la Cour pour n'avoir pas transposé en droit national, en ce qui concerne le territoire de Gibraltar, la directive 2001/19/CE améliorant et simplifiant le système de reconnaissance mutuelle des qualifications professionnelles. La Commission a envoyé des avis motivés à l'Allemagne et à l'Autriche afin qu'elles mettent en oeuvre cette même directive 2001/19/CE. Le Portugal a reçu un avis motivé l'invitant à mettre en application correctement au niveau national les directives 89/48/CEE et 92/51/CEE instituant le système général de reconnaissance professionnelle pour la profession de pharmacien biologiste.[04] Libre prestation des services et établissement : procédures d'infraction contre l'Espagne, l'Italie et la FranceLa Commission européenne a décidé de traduire l'Espagne devant la Cour de justice européenne en ce qui concerne sa législation sur le transfert de portefeuilles d'assurance entre opérateurs, qui constitue selon la Commission une discrimination envers les assureurs non espagnols. La Commission a également demandé formellement à l'Italie de modifier sa législation relative aux activités des "consultants du travail" ('consulenti del lavoro') et au recouvrement extrajudiciaire des crédits. L'Italie est également invitée à rendre le statut de l'Aero club central italien compatible avec le Traité CE, en supprimant les éléments qui constituent une discrimination fondée sur la nationalité et une entrave à la liberté d'établissement sur le plan transfrontalier. Par ailleurs, la Commission demande à la France d'appliquer sans discrimination son régime pour la prise de photographies aériennes, qui impose actuellement une obligation d'autorisation exclusivement aux ressortissants non-français. Ces demandes ont pris la forme d'avis motivés, la deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. Si un Etat membre qui a reçu un avis motivé ne donne pas de réponse satisfaisante dans le délai fixé (généralement deux mois), la Commission peut saisir la Cour. La Commission a aussi procédé au classement de deux procédures d'infraction, contre la Belgique (antennes paraboliques) et contre le Portugal (laboratoires d'analyses), qui ont été résolues de façon satisfaisante.[05] Commission requests Portugal to change discriminatory rules on tax relief for capital gains from home salesThe European Commission has sent Portugal a formal request to amend its legislation according to which capital gains from home sales attract tax relief only if the proceeds are reinvested in a Portuguese home. The Commission considers that not allowing tax relief where the proceeds are used to acquire homes in other Member States is contrary to EC Treaty rules, including those on the free movement of persons. The request is in the form of a 'reasoned opinion' under Article 226of the EC Treaty. If Portugal does not reply satisfactorily to the reasoned opinion within two months the Commission may refer the matter to the Court.[06] Fiscalité directe : la Commission décide de citer la Belgique devant la Cour de justice concernant l'imposition des prestataires de services non belgesLa Commission européenne a décidé de citer la Belgique devant la Cour européenne de justice au sujet des obligations fiscales qu'elle impose aux entrepreneurs utilisant les services de sous-traitants étrangers dans le secteur de la construction. La Belgique contraint l'entrepreneur principal à opérer une retenue de 15% sur les paiements effectués à ses sous traitants et d'assurer la responsabilité solidaire de l'impôt dû par un sous traitant dans le cas où celui-ci n'est pas enregistré en Belgique. Ces mesures fiscales enfreignent les règles du traité CE concernant la libre prestation des services (articles 49 et 50).[07] Company law : Commission asks Germany to end discrimination against companies from other Member StatesThe European Commission has formally requested the German government to amend national rules which discriminate against companies from other Member States which enter into agreements where they acquire rights to the transfer of profits or of control from companies based in Germany. Currently, if shareholders in the company transferring the rights exercise their option to sell their shares to the company acquiring the rights, the latter may, if it is a German company, pay in either cash or shares. However, non-German companies must pay in cash. In the Commission's view, this difference in treatment constitutes an infringement of the freedom of establishment as guaranteed by Articles 43 and 48 of the EC Treaty. The Commission's request takes the form of a reasoned opinion, the second stage of the infringement procedure laid down in Article 226 of the Treaty.[08] Germany : Commission pursues legal action for breaches of EU environmental lawThe European Commission has decided to pursue infringement proceedings against Germany in four cases concerning EU environment law. With this action, the Commission seeks to ensure that Germany complies fully and correctly with agreed law. Only in this way, can citizen get the level of protection of their environment and health that they expect. The Commission will send Germany warnings for incomplete legislation on car recycling, water management and Germany will also receive warnings over missing plans to improve air quality in some of its regions and insufficient control of substances that deplete the Earth's ozone layer.[09] Austria : Commission pursues legal action for breaches of environmental legislationThe European Commission has decided to pursue infringement proceedings against Austria in four cases concerning EU environment law. The Commission's action seeks to ensure that Austria provides its citizens with the level of environmental protection that they can expect. Austria will be referred to the European Court of Justice over gaps in its nature protection legislation, which fails to respect the EU's Birds and Habitats Directives. Further warnings will be sent for failure to fully align Austrian legislation with EU laws on the prevention of major industrial accidents and on car recycling. Austria will also receive a warning for the lack of plans to improve air quality in some of its regions.[10] EU/ACPs : EU and Caribbean progress in initial phase of EPA negotiationsSenior EU and Caribbean officials met in Brussels on Thursday 15 July to advance negotiations for an Economic Partnership Agreement which were launched in April. There was a broad understanding on the scope and priorities of the negotiations, which are aimed at promoting sustainable development in the Caribbean through increased trade, investment and regional integration. Agreement was reached on modalities for a task force set up to facilitate the inter-linkage between the negotiations and development assistance. Both sides also agreed to hold a number of technical and high-level negotiating meetings starting after the summer, so as to focus on specific issues relating to Caribbean regional integration relevant to the Economic Partnership Agreement.[11] Dynamiser l'économie en améliorant la santé : David Byrne lance un processus de réflexion sur l'avenir de la politique européenne de la santéUne Europe en meilleure santé et plus compétitive : David Byrne, Commissaire responsable de la santé et de la protection des consommateurs, a exposé la manière de parvenir, selon lui, à cet objectif. Parlant au European Policy Centre à Bruxelles le 15 juillet, il a présenté sa vision des principes essentiels qui devraient guider le développement de la politique européenne de santé au cours des prochaines années. Parmi ceux-ci, il y a lieu de mentionner le rôle d'une bonne santé comme moteur de croissance économique, la nécessité de promouvoir la santé et de prévenir les maladies plutôt que de se contenter de traiter celles-ci, et l'urgence de remédier aux inégalités en matière de santé tant entre les Etats membres qu'en leur sein. Faire de la santé l'objet d'une responsabilité partagée entre les citoyens, les gouvernements nationaux et l'UE figure au coeur de cette réflexion. L'UE a un rôle crucial à jouer à cet égard en promouvant les synergies et les partenariats entre Etats membres et entre les gouvernements et la société civile. Elle peut aussi favoriser la mise en réseau des compétences en matière de santé en Europe. Les réflexions du Commissaire Byrne sur les développements politiques futurs sont publiées sur le site Santé publique de la Commission. The Group will advise and assist the Commission in the integration of EU securities clearing and settlement systems. The Group is chaired by the Commission.
