    [01] Droits fondamentaux de l'Union européenne : la Commission met l'accent sur la valeur ajoutée de la future Charte

    L'Union ne peut pas se baser exclusivement sur des considérations purement économiques. Elle doit au contraire trouver désormais son fondement sur les valeurs humaines et fondamentales, communes à tous les pays européens. C'est une condition nécessaire pour que les citoyens et les citoyennes donnent leur confiance à la poursuite de la construction européenne. Il faut les convaincre que l'Union forme un cadre dans lequel ils peuvent s'identifier. C'est ce qu'estime la Commission européenne dans une communication adoptée aujourd'hui.

    [02] La Commission approuve le Code de Bonne Conduite Administrative dans les relations avec le public

    La Commission européenne a approuvé le Code de Bonne Conduite Administrative dans les relations avec le public. L'adoption de ce Code marque une nouvelle étape dans le développement d'une culture fondée sur la notion de service, qui constitue un des engagements centraux du Livre Blanc sur la stratégie de réforme. Le nouveau Code guidera le personnel de la Commission dans ses relations avec le public. Il informera ce dernier de la qualité de service à laquelle il a droit dans ses relations avec la Commission. Le code établit des objectifs ambitieux mais réalistes. Les efforts de la Commission dans ce sens seront soutenus par un programme de formation du personnel, de publicité auprès du public et de suivi régulier.

    [03] Commission welcomes the success of first steps in gas liberalisation in Europe

    The European Commission welcomes the success of first steps in gas liberalisation in Europe. However, it deplores the delays in formal directive implementation in some countries and already sends formal notices to France, Luxembourg and Portugal for no-communication of implementation laws. Loyola de Palacio, vice-president in charge of Energy and Transport, stated : "Liberalisation is on the good way and the first effects on prices and European companies competitiveness should be seen in the next future. Now we must ensure that both electricity and gas liberalisation will create the real European Internal Energy market we need."

    [04] Sri Lanka elections

    The European Commission has today approved a euro 701,385 project for an EU mission to observe the parliamentary elections in Sri Lanka on 10 October. The mission will consist of a core team of 6 experts, including a Chief Observer, and 28 long-term campaign observers, who will all arrive in Sri Lanka early next week, and observe the remainder of the campaign in Colombo and the provinces. A further 40 short-term observers will arrive in the week leading up to the poll.

    [05] Fabrizio Barbaso et Jean-Luc Demarty nommés Directeurs Généraux adjoints à la DG Agriculture

    Sur proposition du Commissaire à l'Agriculture, Franz Fischler, et en accord avec Neil Kinnock, Vice-Président chargé de la Réforme administrative, la Commission a décidé de nommer Fabrizio Barbaso (italien, 51 ans) et Jean-Luc Demarty (français, 48 ans) en qualité de Directeurs Généraux adjoints.

    [06] Romano Prodi welcomes lifting of sanctions against Austria

    Romano Prodi, President of the European Commission, said : "The Commission never wanted Austria to be isolated and I am glad to see sanctions lifted. But the Union must remain vigilant about extremism and xenophobia, wherever they arise in Europe. And we must learn the lessons of this episode : I hope we will agree to refine the instruments we have to deal with such problems. I want to see improvements to the treaty, to make it easier to avoid such a situation arising again. The Commission stands ready to provide any assistance it can, to ensure that the values of the Union are upheld."

    [07] La Commission autorise l'acquisition du contrôle du voyagiste italien Alpitour par Ifil

    La Commission européenne a autorisé l'acquisition du contrôle du voyagiste italien Alpitour par Ifil, qui appartient au groupe italien G. Agnelli & C. Sapaz. L'opération ne modifie pas la structure de la concurrence sur le marché italien de l'apanisation de voyages, car la présence d'Ifil y est limitée à la société Alpitour, dont la part de marché est de 16%.

    [08] La Commission autorise Unión Fenosa à prendre une participation dans la société espagnole Cable i Televisió de Catalunya (Menta)

    La Commission européenne a autorisé Union Fenosa Inversiones SA à acquérir une participation dans Menta, lui permettant ainsi de prendre le contrôle du câblo-opérateur catalan, conjointement avec Telecom Italia et Endesa Telecomunicaciones. L'opération n'entraînera pas de chevauchement supplémentaire des activités des parties et, partant, ne soulève pas de problèmes du point de vue de la concurrence.

    [09] Commission clears joint buy of Eutectic by Messer Industrie and Carlyle Europe partners

    The European Commission has approved an operation whereby Messer Industrie GmbH (Germany) and Carlyle European Partners LP, part of the US investment fund the Carlyle Group, acquire joint control of certain assets of the Eutectic and Castolin Group.

    [10] Commission study points to the link between economic fundamentals and exchange rates

    An econometric study by the European Commission's Directorate General of Economic and Financial Affairs shows that fundamental determinants, such as the net foreign asset position and the international relative productivity growth of the tradable vs. the non-tradable sector, can explain trend movements of the effective real exchange rates of OECD countries. The study covers the period 1980 to 3rd quarter 1999. The estimates indicate an under- valuation of the euro by around 15% in effective terms in the third quarter of 1999.     [11] EU scientists do not share Italian concerns on certain GMO derived products

    The Scientific Committee on Food (SCF) has today published an opinion responding to Italian concerns on the safety of seven GMO derived food products which are currently on the market in the EU. The products concerned are oils from three genetically modified oilseed rapes and processed products from four genetically modified maize varieties. On 4 August this year the Italian government suspended the marketing of products derived from the four genetically modified maize varieties, invoking the safeguard clause of the Novel Foods Regulation (258/97/EC, Article 12). This article states that if a Member State has detailed grounds as a result of new information or a reassessment of existing information for considering that the use of a food or a food ingredient endangers human health or the environment, that Member State may either temporarily restrict or suspend the trade of the product in question on its territory. The legislation foresees that the matter is then examined by the Commission and referred to the Standing Committee of Foodstuffs, composed of representatives of the 15 Member States. The SCF has examined the scientific arguments presented by the Italian authorities. The SCF finds that no detailed scientific grounds are given for considering that the use of this type of foods or food ingredients endangers human health. As foreseen under the Novel Food legislation, the matter will be referred for decision to the Standing Committee on Foodstuffs. The next meeting of the Committee will be on 18-19 October.     [12] Australia lifts curbs on Olympic Games media coverage

    Australia's Olympic authorities have lifted their planned curbs on Olympic Games media coverage. As a result, foreign television news agencies, including the news agencies Reuters and Associated Press, will be entitled to permanent passes that would not have been issued under Sydney's original plans. Welcoming this decision, European Trade Commissioner Pascal Lamy said : "This is a fair decision by the Australian authorities, which opens up access to media coverage of the Olympic Games on a non-discriminatory basis".

    [13] Dangerous substances : Commission moves against the Netherlands, Portugal and Finland

    The European Commission has decided to issue Reasoned Opinions (second warning letters) against Portugal and Finland for their failure to communicate national legislation to implement a 1998 Directive on dangerous substances. The Commission also decided to refer the Netherlands to the European Court of Justice for its failure to correctly implement 1997 Directive on dangerous substances.

    [14] Access to Environmental Information : Commission moves against Austria

    The European Commission has decided to send a Reasoned Opinion (second warning letter) to Austria for failure to implement correctly the Access to Environmental Information Directive. Austria has adopted a number of pieces of legislation at the Federal and Regional level to implement this Directive. However, several shortcomings were identified by the Commission in all the Federal and Regional legal acts sent to the Commission by Austria. Therefore, the Commission addressed a letter of formal notice (first warning letter) to Austria last year. Much of the legislation has subsequently been corrected and completed as regards the Federal law and the laws of three Regions. However, a number of Regions, in particular Burgenland and Salzburg have still not provided the Commission with appropriate implementing legislation and shortcomings have been identified with regard to legislative drafts provided by the Regions of Lower Austria and Carinthia (and to a minor extent with regard to existing legislation of Styria and the Tyrol).

    [15] Substances dangereuses dans l'eau : l'action de la Commission à l'encontre de la Grèce, de la France et de l'Irlande

    La Commission européenne a décidé de poursuivre son action à l'encontre de la Grèce, de la France et de l'Irlande pour non-respect de la directive de l'Union européenne sur les substances dangereuses de 1976. Dans le cas de la Grèce, la Commission a décidé d'envoyer, conformément à l'article 228 du traité, un avis motivé (deuxième lettre d'avertissement) concernant le manque de mesures d'épuration du lac Vegoritis. En 1998 déjà, la Cour de justice européenne (CJE) avait condamné la Grèce pour le même motif et l'action de la Commission fait suite à cet arrêt de la Cour. Dans le cas de la France, la Commission a décidé d'introduire une requête auprès de la CJE en raison de manquements généraux aux dispositions de la directive en matière de programmes de réduction de la pollution par des substances dangereuses. Dans le cas de l'Irlande, la Commission a décidé d'envoyer un avis motivé complémentaire (deuxième lettre d'avertissement) pour des manquements similaires. Cette décision de la Commission couvre aussi certaines faiblesses des mesures irlandaises en ce qui concerne le phosphore, la substance qui est la plus préoccupante pour la qualité de l'eau en Irlande.

    [16] Normes environnementales applicables aux carburants : la Commission poursuit les procédures contre l'Allemagne et l'Italie

    La Commission européenne a décidé d'émettre des avis motivés (à titre de deuxième avertissement) contre l'Allemagne et l'Italie, qui n'ont pas envoyé à la Commission le texte des dispositions législatives nationales donnant effet à la directive de 1999 qui fixe des normes environnementales applicables à l'essence et au diesel. Le délai de transposition de cette directive en droit national était le 1er juillet 1999. La Commission a déjà envoyé en novembre 1999 aux deux Etats membres des lettres de mise en demeure (à titre de premier avertissement), et, en l'absence de réponse, a décidé de poursuivre la procédure.

    [17] Oiseaux sauvages et habitats naturels : la Commission dénonce les lacunes de la législation belge, suédoise, portugaise et luxembourgeoise

    La Commission européenne a décidé de poursuivre son action à l'encontre de la Belgique, de la Suède, du Portugal et du Luxembourg pour des lacunes dans la législation nationale transposant la directive européenne sur les oiseaux sauvages et la directive sur les habitats naturels. En ce qui concerne la directive sur les oiseaux sauvages, la Commission a décidé de poursuivre la Suède devant la Cour de justice européenne et d'envoyer deux avis motivés (deuxièmes lettres d'avertissement) à la Belgique. Dans le cas de la directive sur les habitats naturels, la Commission a décide de poursuivre la Belgique et le Luxembourg devant la Cour de justice et d'envoyer un avis motivé à la Suède. La Commission a décidé également d'envoyer un avis motivé au Portugal en raison de lacunes dans la législation portugaise transposant les deux directives.

    [18] Protection of an important bird area : Commission acts against Finland on mires of Kemihaara

    The European Commission has decided to send a letter of formal notice (first warning letter) to Finland for failure to protect an important bird area called mires of Kemihaara in north-east Finland. The Finnish authorities recently granted a construction permit to the Vuotos power plant and artificial lake project which would drown approximately 250 square kilometres of mires and forests around the upper Kemijoki river, including the mires of Kemihaara where a great number of bird species listed in Annex I to the Wild Birds Directive are occurring. The Commission considers that there is evidence of non-application of the required nature conservation safeguards for projects or plans having negative impacts on important conservation sites. In another legal action pending in the European Court of Justice against Finland for non-designation of bird areas, the Commission argues that, in view of its ornitological importance, the mires of Kemihaara should have been designated as a Special Protection Area (SPA) under the Wild Birds Directive.
