    INTRO: CROAT OFFICIALS HAVE BOYCOTTED THE FIRST MEETING OF THE NEWLY ELECTED CITY COUNCIL IN MOSTAR, IN SOUTHERN BOSNIA-HERZEGOVINA. THE CROATS LOST THE ELECTIONS IN MOSTAR THREE WEEKS AGO, BUT NOW, CITING VOTING IRREGULARITIES, THEY ARE REFUSING TO RECOGNIZE THE ELECTION RESULTS. DAVID FOLEY IN SARAJEVO REPORTS OFFICIALS SAY THE BOYCOTT IS A SERIOUS SETBACK TO HOPES FOR NATIONAL ELECTIONS IN BOSNIA IN SEPTEMBER.

    TEXT: THE ELECTION IN LATE JUNE WAS MEANT TO CHOOSE A UNIFIED CITY COUNCIL AND HELP RECONCILIATION IN MOSTAR, WHICH IS BITTERLY DIVIDED BETWEEN MUSLIMS AND CROATS.

    IN A SURPRISING RESULT, MUSLIMS, WITH THE HELP OF LOCAL SERB ALLIES, GAINED A NARROW MAJORITY ON THE COUNCIL. CROAT OFFICIALS HAVE REFUSED TO ACCEPT THE RESULT, AND HAVE BOYCOTTED THE FIRST COUNCIL MEETING.

    AT ISSUE ARE BALLOTS CAST BY BOSNIAN REFUGEES IN GERMANY, WHERE THERE WERE 26 MORE BALLOTS THAN VOTERS. THE VOTING WAS ORGANIZED BY THE EUROPEAN UNION, AND UNDER E-U RULES THE ELECTION IN GERMANY SHOULD HAVE BEEN RERUN. BUT USING WHAT SOME DESCRIBE AS "VERY THIN LEGAL TECHNICALITIES," THE E-U OMBUDSMAN SIMPLY INVALIDATED 26 VOTES AND LET THE RESULT STAND.

    SENIOR INTERNATIONAL OFFICIALS BLAME THE EUROPEAN UNION FOR THE PROBLEMS. TOM WALKER, THE E-U SPOKESMAN HERE DISAGREES.

    I THINK THAT CRITICISM IS HARSH. I CAN SEE THE CROATS POINT OF VIEW THAT MAYBE WE WERE A LITTLE BIT PREMATURE IN GOING WITH THE RESULT OF THE OMBUDSMAN. BUT THE OMBUDSMAN IS OUR LEGAL EXPERT IN THE FIELD, AND HE RULED THAT WAY, AND THAT HAS TO BE RESPECTED.

    BUT THOSE EFFORTS HAVE APPARENTLY FAILED, AND CRITICS SAY BY IGNORING IT'S OWN RULES, THE E-U HAS GIVEN THE CROATS A LEGAL BASIS FOR REFUSING TO RECOGNIZE THE ELECTION RESULT. THEY SAY A PRECEDENT HAS NOW BEEN ESTABLISHED WHICH WILL ALLOW LOSING PARTIES TO IGNORE UNWANTED RESULTS IN NATIONAL ELECTIONS IN SEPTEMBER. MR. WALKER AGREES THIS COULD BE A PROBLEM.

BUT I THINK I SHOULD ADD SOMETHING HERE, THAT'S MINES HAVE ALMOST BECOME A GENERIC TERM, COVERING MORE THAN JUST MINES. BUT ONE OF THE MAJOR PROBLEMS IN MOZAMBIQUE IS WHAT WE TERM THE VILLAGE MINEFIELD, WHERE THE POPULATION WAS CONCENTRATED BY THE GOVERNMENT FORCES TO PROTECT THEM FROM THE GUERRILLAS, TO DENY ACCESS TO THEM FOR POLITICIZATION, FOR FOOD. AND A CHEAP, EFFECTIVE WAY OF DOING THAT WAS TO PUT SMALL FORCES INTO THE VILLAGE AND SUPPLEMENT THEIR PROTECTION BY LANDMINES.
